| 摘 要： | 研究目的：基于《物权法》对土地承包经营权的物权化改造的讨论，旨在改进土地承包经营权立法的完整性和合理性。研究方法：文献资料法和比较分析法。研究结果：土地承包经营权作为一种特殊的用益物权，应当允许土地承包经营权抵押，明确承包地被征收的“公共利益”需要和细化征地补偿标准。研究结论：要解决农村土地承包经营权存在的问题、完善农村土地制度，就要切实改进对农村土地承包经营权的物权化建构。

| Abstract: | The purpose of this paper is to improve the integrity and the rationality of the legislation on the rural land contract operation rights（RLCOR）through the discussion on the reform of real right of RLCOR based on the “Real Rights Law”. Methods of documentation and comparison were employed. As a special usufruct, the RLCOR should be allowed for mortgage while the demand of“public interest” attached to expropriated contracted land as well as the compensation standards has to be specified. In order to solve the existing problems in RLCOR and perfect the rural land system, it is necessary to improve the framework construction of real right of RLCOR. |
