Neoliberal land policies such as land administration seek to improve property rights and the efficiency of land markets to boost rural economic production. Quantitative studies of pre-existing land markets can help planners to tailor these policies to local conditions. In this article we examine an extra-legal land market currently being modernized by a World Bank-sponsored land administration effort. Specifically, we use a hedonic-type revealed preference model and household survey data to estimate the factors affecting extra-legal land prices along an agricultural frontier in Petén, Guatemala. Our model indicates that land value is significantly affected by land attributes including location, tenure status, presence of water, distance to roads, and distance to landowners’ homes, and that land prices in the northwestern Petén are estimated to have risen on average 26.5% per year between 1977 and 2000. We contend that this rate of increase provides a strong incentive for colonists to speculate in land rather than invest in state sanctioned property rights. We conclude that if frontier development programs, such as land administration, are to become attractive to settlers in Petén and elsewhere, they must compete favorably with economic incentives associated with land speculation, or alternatively, target landowners who are not interested in playing the land market.  相似文献

The post-socialist countries underwent dramatic changes in agricultural land ownership and production system. Former socialist collective farms have been dismantled, rural land has been privatized, and land markets have been formalized. Nevertheless, more than a decade later farming associations still persist in the choices that landowners make in terms of land reallocation despite collective action problems and the availability of leasing-out land as a close substitute. While the decision of farming the land individually has been well understood, there is less research on why landowners join farming associations rather than participate in land transactions. The paper examines this question using household survey data from the two largest agro-regions in Romania. I find that farming associations constitute a good land reallocation option for landowners that are resource constrained but are still willing and able to be engaged in farming. Associations provide security of tenure and capital access, allowing landowners to draw on the benefits of scale economies. Leasing-out is a viable alternative for younger landowners who can engage in non-farming activities and for older landowners with limited farming abilities.  相似文献

This article is a case study of phase one of the World Bank's land administration project in Petén, Guatemala. Although the project's stated aims are merely to formalize an existing set of individual landed property rights, this development intervention necessarily changes the property regime, thereby changing underlying relationships that land as property embodies. Impact evaluations conducted by development economists may fail to substantively address displacement and violence that occur as a short-term effect of the project and long-term disparate impacts of the project that may exacerbate existing inequalities. The case of Petén also highlights the possibility for violent enforcement of property boundaries, where conflict surges between the disenfranchised and those who gain power under the new property regime.  相似文献

This paper examines the current situation following from the implementation of a land cadastre in the Republic of Moldova, a transition country that is seeking to establish a market economy as a means of facilitating greater prosperity. After consolidating the concepts of the functions land property serve within a capitalist-based economy, we examine the current state of affairs as it exists on the ground within this former socialist state and examine the consequences of imposing western-derived views on land reform in terms of tenure security and credibility. This reveals an extensive problem of land fragmentation in the rural sector, which is in part being countered by the emergence of a land lease market that sees new individual landowners providing land for the use of commercial enterprises. However, given the unique political economy present within Moldova, this situation in many ways contradicts, if not constrains, many of the potential benefits that a formal property system is thought to allow for, and therefore the objectives behind the transition phase have yet to be fully achieved. This has forced a re-examination of theory versus the practice of land property privatisation and land market interactions.  相似文献

Rural land rental markets in China play an increasingly important role in the transformation of the agricultural sector. This study focuses on the rural land rental market in the Xishuangbanna Dai Autonomous Prefecture in Southern China, a mountainous region, where rapid changes in land use have taken place with the transition from traditional agriculture and a tropical rainforest to rubber monoculture. Notably, we assess the impacts of population aging, land tenure security, and ethnicity on the participation of smallholders in the land rental market. The analysis suggests that a higher proportion of older people in a household increases the likelihood of renting out land and reduces the probability of renting in land, implying that population aging fosters land rental market development by transferring land from older to younger farmers. We also confirm that the availability of a land tenure certificate has a significant and positive impact on the renting out of land. Furthermore, ethnic minority groups are less likely to rent out land, indicating that land rental markets are ethnic sensitive. Additionally, specialization in rubber farming, household wealth and the altitude of household location also influence participation in the land rental market.  相似文献

This paper investigated youth access to agricultural land under customary land tenure in Ghana. Using Techiman Traditional Area as a case study, the study applied multiple sampling techniques in a multi-stage sampling process to select the study communities and respondents. A total sample of 455 youth respondents and 23 elders were covered in twenty peri-urban and rural communities. The study revealed that irrespective of whichever mode (market or non-market) the youth employed to access agricultural land, in rural or peri-urban areas, there were constraints to their land sizes. Majority of the youth, both indigenes and migrants, held small land sizes of 1–3 acres for farming purposes. The underlying causes were two-fold: demand-related such as high cost of accessing land and competition from residential developers and supply-related such as unwillingness of the elders to release land and increasing scarcity of productive family land, among others. It is thus the conclusion of the paper that more research should be conducted across the country into youth access to agricultural land under customary tenure as a means of formulating an evidence-based youth agricultural land access policy for the country. There is also the need for public education of customary authorities to sensitize them on the need for making land accessible to the youth for agricultural purpose.  相似文献

In China, rural land is collectively owned at the village level. Village officials usually have the power to reallocate land property across families on an ongoing basis due to demographic changes in the village. Realizing that frequent land reallocation and abusive land requisition will undermine economic productivity as well as social stability, the “Rural Land Contract Law” passed in 2002 explicitly reads that farmland tenure security must be maintained for at least 30 years since the last nationwide reallocation in 1998. The frequency and magnitude of land reallocation in Chinese villages have decreased as a result. However, failure to allocate land to the newly increased population often induced conflicts among village members if the security of land tenure for 30 years was strictly implemented. Administrative land reallocations then still continued in some villages to accommodate demographic changes in these places. Based on an almost nationally representative rural dataset collected in 119 villages of 6 provinces across China in 2008, this paper lays out some stylized facts about the administrative land reallocation after 1998. By analyzing the opinions of over 2200 farmers on the central policy of maintaining farmland tenure security, we are able to rationalize why some farmers support the policy while others oppose it. This analysis helps us to better understand the dilemma between efficiency and equity embedded in the current agricultural land system in China. It is further shown that social conflicts among village members may easily arise either due to administrative land reallocation or due to lack of it. We argue that this dilemma cannot be resolved effectively without coordinated reforms in household registration system which can help hundreds of millions of Chinese rural migrant workers to permanently settle in cities and release their farmland to those who stay in the countryside.  相似文献

In recent decades the intensification of agricultural production in many European countries has been one of the key components of land-use change. The impact of agricultural intensification varies according to national and local contexts and a greater understanding of the drivers of intensification will help to mitigate against its negative impacts and harness potential benefits. This paper analyses changes in land use intensity in six case studies in Europe. A total of 437 landowners were interviewed and their responses were analysed in relation to changes in land use intensity and agricultural production between 2001 and 2011. In the case studies in Western and Eastern Europe we observed stabilisation during the last decade, and no clear tendency of increase or decrease of land use intensity. The use of fertilizers and pesticides seems to have decreased in our cases in Western Europe, which is contrary to trends in Eastern Europe. Agricultural production remained stable in almost all cases, except for an increase in Austria and Romania which may indicate that the farming efficiency has increased. A statistical analysis showed a division between study areas in Romania and Austria (increasing land use intensity) versus those in the Netherlands, Denmark and Greece (decreasing). In the Mediterranean cases we observe a process where agriculture is becoming increasingly marginalised, at the same time as changes in function with regard to urbanisation and recreational land uses have taken place. Logistic regression highlighted the importance of farm size and farmer type in understanding changes in land use intensity. The dominant pattern of stabilisation which has occurred over the past 10 years may also partly be a result of effective EU and national environmental and agricultural policies, which are increasingly concerned with improving environmental conditions in rural areas.  相似文献

It is generally believed that tenure security has improved due to the programme of land certification. In this paper I argue the opposite. Tenure security concerns three different rights: possession, renting and latent rights. Rights of possession are believed to have improved, but the evidence is weak and conflicting. Land rentals are expanding and farmers face high tenure insecurity. The main problem, though, is latent rights, with great insecurity and increased conflict levels. Despite rapid economic development there is considerable social malaise, an unfortunate agricultural structure, and considerable pressure for land redistribution due to unresolved land tenure issues. Land fragmentation has been identified to greatly undermine crop production in many countries. In the case of Ghana’s customary tenure system, household farmlands are relatively small and are highly fragmented. Recent agricultural drives, however, have focused on farm level interventions that are ad hoc with short-term benefits. A sustainable long-term application of land consolidation which reorganises farmlands may improve yields, reduce the cost of production and improve the incomes of farmers. The successful implementation of land consolidation depends greatly on the suitability of local conditions with respect to land tenure and land use. However, in Ghana’s customary lands, the alignment between the requirements for land consolidation and existing conditions remains unexplored. This study investigated the feasibility of land consolidation within the customary tenure by juxtaposing the local conditions of the study areas with the baseline conditions for land consolidation outlined in literature. Using both qualitative and spatial data, the study revealed some traits of convergence and divergence with respect to the baseline conditions in the study areas. For example, conditions such as the existence of land fragmentation, suitable topography and soil distribution were fully met. Conditions such as the existence of a land bank, technical expertise, and infrastructure and supportive legal frameworks were partially met. The remaining conditions such as the willingness to participate, availability of a land information system and favorable land ownership structure were non-existent. The circumstances surrounding these unmet conditions are deeply embedded in customs and traditions that hardly yield to change. Since these conditions are fundamental for land consolidation, their absence negates the feasibility of land consolidation under the current tenure system of the study areas.  相似文献

This article tests the relationships among formalised property rights, land tenure contracts and productive efficiency in farming. Using four rounds of panel data from 230 rice farms in the Philippines, we measure the effects of land tenure arrangements on farm efficiency using a stochastic production frontier model. We test for the allocative efficiency of observed land rental markets. We also test how land tenure security affects farmers' investment decisions. Results suggest that, despite the presence of formalised titles, the rental market remains inefficient at allocating land. In contrast, the unformalised tenure contracts used by farmers appear to provide tenure security.  相似文献

In more developed societies the concept of land tenure security is implicit and backed by long standing institutions. In contrast, the concept is less recognised and carries divergent meanings in developing countries. In these contexts past conceptualisation efforts have favoured reductionist approaches: the concept is narrowed to one aspect or another, but, no shared agreement on a definition prevails. The absence of this basic theoretical knowledge impedes discourse on land policy formulation, implementation, and evaluation. This paper contributes to this issue by revisiting and refining the concept of tenure security in the context of Sub-Saharan Africa's rural poor. Using a systematic review, scientific evidence on the conceptualization issue is provided. A typology of different schools of thought is developed: land tenure security is shown to be understood through (1) economic, (2) legal or (3) adaptation lenses. Generic constructs from these viewpoints tend to dominate the notion of tenure security and subsequent land policy formulation; however, it is argued that none adequately describe the totality of the concept. Using the review results and a systems approach a new inclusive concept of tenure security for rural poor in Sub-Saharan Africa is developed. The refined concept of security is defined as an emergent property of a land tenure system. The content of such security is explained by interactions between all elements of a land tenure system as a whole. It is concluded that rural poor in Sub-Saharan Africa can enjoy the total security when interactions between all elements occur in a dynamic equilibrium.  相似文献

Land tenure regime is considered one of the most crucial assets determining viability of urban agriculture, especially in terms of investments. Many authors have built on traditional agricultural theory that only land ownership and (formal) secure land tenure can incite investments into farming, thus stressing the need of secure land tenure for more prosperous urban agriculture. However, these statements are often built on weak or nonexistent empirical evidence. This research aims to contribute to the discussion on land tenure for urban agriculture by mixed-method exploration of the above-mentioned theory. Additionally, we propose a farming investment index which measures the level of investments by using non-monetary information obtained from respondents. The results of our study show that land tenure security for urban farmers is often seen as a rather narrow concept, focusing only on legal tenure security but omitting its other dimensions such as perceived and de facto tenure security. Nevertheless, all three dimensions of tenure security positively influence investments to urban agriculture.  相似文献

通过构建一个包括全球近200个国家和地区的数据库并进行系统分析,总结归纳大规模土地确权的失败教训和成功经验。目前全球仍有约一半的发展中国家缺乏正规的地权制度,已实施确权的发展中国家颁证率大多低于50%。失败教训表现为,传统习俗地权制度的冲突、农民认知及支持不足、确权分配不公导致确权需求不足;基础设施建设落后、实施执行不力、配套制度建设未跟上造成确权有效供给缺乏。成功经验表现为,国家能力建设和充分的前期准备是关键,地方政府的有力执行和顺势调整是保障,广大农民确权认知的加强和支持是基石。制定更为清晰合理的确权目标,采用更加适应当地情况的多样化确权方式,做好法律和组织建设等前期工作,探索城乡建设用地统一市场和农地信贷市场建设,有利于我国确权工作的顺利进行和最终成功。  相似文献

Despite a growing interest among land use policymakers to identify the indicators that measure changes in land tenure systems, little consensus exists about what framework can functionally analyze land tenure systems, and how it should be developed. The existing indicators have mainly focused on measuring the “effects” of land tenure (in)security and often neglected the “causes”. Hence, comprehensive monitoring of land tenure systems has been poorly understood and practiced. Given their multifaceted meanings, land and its related concepts have been a challenging issue for policymakers. Accordingly, the overall objective of this paper was to propose a functional and analytical framework on how to study monitoring land governance from roots to shoots through five main studies: i) understanding the historical trajectories of land, ii) recognizing institutional arrangements on land, iii) identifying land governance grammar, iv) defining land governance typology, and v) assessing land use changes. In line with this objective, the general research question of this study is how and by whom a monitoring system should be developed. Overall, this study can be considered as a conceptual framework that has been designed to conceptualize, develop, build, and apply a functional and analytical framework for formulating land governance grammar to explain how access to land is governed. Unlike previous studies, this study focuses on both causes and effects of strong land governance (SLG) and weak land governance (WLG). The paper discusses that land governance allows various stakeholders to participate in government decisions and ensures the security of their livelihoods. However, land governance could be either poor or strong depending on the government decision-making process. The paper also concluded that SLG is a precondition for economic growth and poverty alleviation in rural areas of developing countries.  相似文献

Land tenure in Namibia is regulated by a variety of Acts, some of which date back to as far as 1937, and some of which are yet to be approved by Cabinet. This variety of Acts makes it difficult to evaluate the performance of land administration as a whole, and the appropriateness of coercive instruments with regards to urban land tenure in particular. In this article we evaluate how urban land tenure regularization practices are conducted in Namibia, and to compare new formal procedures, designed to address problems of efficiency and efficacy, to older existing procedures, supposedly not efficient or effective. This evaluation uses a theoretical framework of Pritchett and Woolcock [Pritchett, L., Woolcock, M., 2004. Solutions when the solution is the problem: arraying the disarray in development. World Development 32 (2), 191–212], which deals with public service delivery and transaction-intensive services. Applying this framework for a comparative analysis of 5 different land subdivision practices – each relying on a different land-related act – we conclude that the degree of regulation and regularization is perhaps not so much a solution for urban land tenure problems but more of a problem in itself.  相似文献

The goal of this paper is to understand the nature of the property rights associated with China's land tenure systems and to study the impact of these property rights on agricultural production efficiency. The results show that land tenure and associated property rights in rural China affect the production behavior of farmers. The most robust finding is that the right to use land for long periods of time encourages the use of land-saving investments. While the results show that land tenure affects agricultural production decisions, the difference between collective and private plots, however, is small compared to the private plot - communal productivity gap that existed in the pre-reform period.  相似文献

Fed by demand for beef within Brazil and in global markets, the Brazilian herd grew from 147 million head of cattle in 1990 to ≈200 million in 2007. Eighty-three percent of this expansion occurred in the Amazon and this trend is expected to continue as the industry bounces back from a recent agricultural downturn. Intensification of the cattle industry has been suggested as one way to reduce pressure on forest margins and spare land for soybean or sugarcane production, and is the cornerstone of Brazil's plan for mitigation of greenhouse gas emissions. To this end, federal credit programs and research and development activities in Brazil are aligning to support intensification goals, but there is no guarantee that this push for intensification will decrease the demand for land at the forest margin and as result curb CO2 emissions from deforestation. In this paper we use a spatially explicit rent model which incorporates the local effects of biophysical characteristics, infrastructure, land prices, and distance to markets and slaughterhouses to calculate 30-year Net Present Values (NPVs) of extensive cattle ranching across the Brazilian Amazon. We use the model to ask where extensive ranching is profitable and how land acquisition affects profitability. We estimate that between 17% and 80% of land in the Amazon would have moderate to high NPVs when ranched extensively if it were settled, i.e. if the rancher does not buy the land but acquires it through land grabbing. In addition, we estimate that between 9% and 13% of land in the Amazon is vulnerable to speculation (i.e. areas with positive NPVs only if land is settled and not purchased), which suggests that land speculation is an important driver of extensive ranching profitability, and may continue to be in the future. These results suggest that pro-intensification policies such as credit provision for improved pasture management and investment in more intensive production systems must be accompanied by implementation and enforcement of policies that alter the incentives to clear forest for pasture, discourage land speculation, and increase accountability for land management practices if intensification of the cattle sector is to deter new deforestation and displace production from low-yield, extensive cattle production systems in frontier regions of the Brazilian Amazon.  相似文献

According to economic theory, tenure security is an important determinant of agricultural investment and productivity. Land titling has been at the center stage of development efforts of many African countries to boost tenure security. We investigate the productivity impacts of the Ethiopian land registration and certification program, employing propensity score matching method in an effort to create a credible counterfactual. Consistent with theory, we find land registration and certification has robust positive effects on farm productivity. More tentatively, we identify the assurance effect as one probable channel for impact. Households with land certificates are more likely to adopt soil‐fertility management strategies on their plots than households without certificates.  相似文献

This paper reports on aspects of land tenure in western Sudan, especially the nature of tenure insecurity and the functioning of the land rental market. The active land rental market accounted for about one-third of cultivated land. Patterns of land rental transactions, and tests of the importance of insecurity in renting land, where the owner may not be able to reclaim land rented out, do not support the presumption that rental markets perform poorly. The role of the sheikh as administrator of village land, and the claims of large landowners to vast tracts, are, however, important political problems that must be resolved before attempts at ‘rationalizing’ land tenure.  相似文献
