Despite its importance and singularity, the EU’s state aid policy has attracted less scholarly attention than other elements of EU competition policy. Introducing the themes addressed by the special issue, this article briefly reviews the development of EU policy and highlights why the control of state aid matters. The Commission’s response to the current economic crisis notably in banking and the car industry is a key concern, but the interests of the special issue go far beyond. They include: the role of the European Commission in the development of EU policy, the politics of state aid, and a clash between models of capitalism. The special issue also examines the impact of EU policy. It investigates how EU state aid decisions affect not only industrial policy at the national level (and therefore at the EU level), but the welfare state and territorial relations within federal member states, the external implications of EU action and the strategies pursued by the Commission to limit any potential disadvantage to European firms, and the conflict between the EU’s expanding legal order and national.  相似文献

This article examines the role played by the European Commission in the development of the European Union’s (EU) state aid policy. It does so through the prism of a “dilemma” that exists at the nexus of the Commission’s delegated authority to administer EU treaty state aid provisions, the discretion conferred on Commission authorities by the imprecise language in which those provisions are written, and the political and institutional control mechanisms EU member governments use to influence the exercise of that discretion. Examining Commission efforts to manage this dilemma over the history of the EU, we provide evidence to illustrate how the Commission’s approach adapted to shifting economic and political conditions.  相似文献

Whilst its impact on national industrial policy has attracted considerable attention in the scholarly literature, the implications of EU state aid policy on regional development policy and its effects on territorial relations inside EU member states have been largely neglected. Drawing on the experience of Bavaria, Flanders and Upper Austria, this article shows how EU action has imposed increasingly wide reaching and detailed constraints on subnational authorities, undermining and eroding their capacity to define and implement regional policy. It thereby also challenges the widely held presumption in the EU literature, as for example by proponents of multi-level governance, that European integration works invariably to empower and strengthen regions in Europe. To the contrary, the case studies show that the autonomy of subnational states in EU member countries with federal systems has been eroded as they have been forced to abandon traditional policies and practices. More generally, the article invites reconsideration of the relationship between European integration and subnational authorities.  相似文献

Since the mid-2000s, the European Commission has employed a so-called ‘more economic approach’ to European state aid control. Under this modified regime, the Commission checks not only whether a state aid has competition-distorting effects, but in addition, whether it enhances social welfare. This reform implies an extension of the Commission’s competences vis-à-vis the Member States as the Commission gets the power to prohibit national state aid regarded as socially wasteful. The Commission explains its reform with the necessity of giving state aid control a sound economic basis. This article, however, demonstrates that the more economic approach – somewhat paradoxically – is not based on a consistent economic view of public policy that would justify the aforementioned shift of competences to the supranational EU level. The economic-theoretical inconsistencies identified in this article may be used by policymakers to rethink some elements of current EU state aid policy.  相似文献

The French and Dutch rejection of the proposed EU Constitution in May 2005 threw the European Union into what many observers regard as its deepest crisis to date. This crisis can also be seen as a unique opportunity for political, economic and institutional renewal, however. This article traces the trajectories of consumer policy in Finland and Germany in the light of a comparative history in order to reflect upon the notion of consumer empowerment in public policy. The principle developments of contemporary consumer policy can be traced back to the post‐war political and economic integrations arising from the initial idea of free markets and individual freedom emphasized in classical liberalism. The article explores this development in Finland and Germany to the point of the establishment of a joint European Union (EU) consumer policy to reveal the notion of consumer empowerment. This approach creates an understanding of the peculiarities of consumer policy in EU member states despite the presence of a joint European policy area. Nowadays, both Finnish and German consumers find EU regulations excessive. It is important to acknowledge the influence of this historic development in order to understand what consumer empowerment meant in the past and thus to further develop policy action on a joint level.  相似文献

Despite the proclaimed return of industrial policy state aid provided by EU Member States is at historically low levels. This fact is at least partly explained by the unique institutional arrangement in the EU which empowers the European Commission to monitor and restrict state aid activities of Member States. Making use of European state aid statistics over the period 1995–2011 we construct a measure for manufacturing state aid and estimate an expanded macro-economic export function to investigate the relationship between state aid for the manufacturing sector and Member States’ export performance. Since national governments can be expected to provide subsidies primarily to foster domestic value added we use value added exports as the export performance measure. Non-stationarity of the data confines us to investigating the short run relationships in which we only find limited evidence for a significant impact of state aid on manufacturing value added exports.  相似文献

The implications for labour markets are central to any political and economic evaluation of EU Eastern enlargement. The resulting new levels of unemployment and of wages will have direct effects on social welfare in the acceding countries as well as in the present member states of the EU. Furthermore, employment and wages are substantial factors of political stability in the central and eastern European countries (CEECs). The following paper analyses the present situation on the labour markets in the CEECs and discusses the effects of their reintegration into the Western European system and the resulting implications for labour market and wage policy institutions. The recent financial crisis has raised significant questions about liberal free-markets as a mechanism for generating economic growth compared to those economies where there is greater state intervention. This article develops a theoretical framework for economic development that can explain historical changes in both industrial policy and economic growth where the state actively intervenes to direct economic development. The article then applies this framework to the case of South Korea where there is a strong interventionist government. The results show that economic development can be explained within a sequential framework of policy intervention and that rather than being a static decision, successful state intervention is a dynamic and evolutionary process.  相似文献

As long as state aid outside the EU is unregulated, the European Commission faces a dilemma: either European firms will be disadvantaged in global competition by strict EU rules, or the Commission will come under pressure to relax the rules, thereby running the risk that fair competition within the EU will be undermined. As a consequence, the Commission attempts to promote EU rules on state aid and public procurement beyond EU borders — in non-member countries as well as at the WTO level. This article analyses the Commission’s channels of regulatory transfer and the factors accounting for its varying success. Bilateral cooperation provides many opportunities to spread European state aid rules, but decentralised enforcement at the national level remains ultimately deficient. Moreover, the transfer of European rules to the multilateral WTO depends heavily on the EU’s ability to reach prior consensus with its most powerful partner and rival, the US government.  相似文献

While European economic integration and in particular the single European market often appear to be only a smallest common denominator in the EU, they condition the economic policy framework facing Member States and have been instrumental in putting governance patterns into motion. The Lisbon Agenda is a case in point. Motivated by competitiveness concerns, it outlines an economic and social strategy meant to relaunch the EU within the changed setting of world-wide competition and a knowledgebased economy. The European Employment Strategy is the subject of controversial discussion. It is hard to find an economic justification for transnational responsibility since European labour markets are heterogenous and spillover effects of national employment policies are almost negligible. In its latest communication, the European Commission fails to provide a masterplan for a recovery of the struggling labour markets, although it provides convincing and less convincing proposals for tackling unemployment in EU member states. There is a suspicion that the package mainly serves as a first step towards transferring employment policy responsibilities from the national to the EU level. But the EU labour market policy lacks appropriate instruments and competences. Finally, it is questionable whether the package fits in an economic growth plan.  相似文献

European Union (EU) state aid policy has an oft-overlooked but politically-charged external dimension that is most clearly witnessed in the linkage with external trade relations. The article seeks to illuminate the issues and potential problems raised by this state aid-trade linkage. When this linkage is made, the EU engages in an array of complex international interactions through which it may pursue two politically-contentious procedures: countervailing duties or dispute settlement. The article argues that an understanding of the EU’s role in these complex interactions must take into account the Union’s institutional landscape and the competing preferences of different private interests. When deciding to impose countervailing duties against foreign state aids (subsidies), private interests play a significant role in initiating investigations and can use their access to EU institutions to encourage the imposition of such measures. While a variety of factors help to explain why the EU prefers pursuing countervailing duties, the Union also actively uses the World Trade Organization’s formal dispute settlement mechanism. Under this alternative, private interests again play an important role, pursuing varying strategies depending on their preferences. The most important determinant of a firm’s preference to pursue countervailing duties or the dispute settlement mechanism appears to be the extent to which the firm is concerned with restoring competition in their home market or with restoring competition in multiple/global markets.  相似文献

The strengths of the European competition regime are outlined before identifying challenges presented by the financial crisis. The argument moves from enforcement to systemic threats to the credibility of the economic models on which modern competition policy is based. It then turns from banking failures to the crisis in the European motor industry. It suggests that competition policy comprises an ‘economic constitution’ for the EU which is under threat, but registers the relative complacency of the competition agencies, and argues for a redefinition of policy. The conclusion suggests that the regulatory relationship between the state and the private sector will reflect scepticism about the market and that political changes in the UK and Europe offer radical choices between a reinforced or a marginalised competition policy which the competition policy ‘community’ needs to confront.  相似文献

The integration of the former communist countries of central and eastern Europe into the European Union creates a dilemma for the EU's regional policy. The EU's expenditure on regional policy (its ‘active’ regional policy) has been guided by political reactions to deepening or enlarging the EU, not by a rational strategy for regional policy. In contrast, the strong EU instrument of state aid control, developed for competition policy (its ‘reactive’ regional policy) has been relatively successful in avoiding a national race of regional subsidies among the member states. We show that a shift from active regional policy to reactive, competition‐oriented, regional policies is the preferred way for the established member states to handle the challenge of enlargement. At the same time, however, this shift is politically difficult for the accession countries to accept, despite the fact that this shift might prove better for them economically. This regional policy dilemma is one of the major obstacles for the full integration of the accession countries into the EU.  相似文献

It has often been argued that European monetary unification must basically be seen as a device to Europeanise re-unified Germany. For the Germans it seemed to be the best possible way to prevent a German “Sonderweg” and end any German ambition for hegemony. For the rest of Europe, and particularly France, it seemed to be the best way to curb German monetary dominance and to secure a French imprint on EU policy-making. In this article, however, it is argued that the German impact on the economic governance regime of EMU and its fencing off the French proposal of a “gouvernement economique” is so substantial that the term “Germanic Europe” seems in fact to be appropriate. More importantly, the economic governance system of “Germanic Europe” has locked the European Union into a politics of disinflation which makes it difficult for the EU to prosper and reap the potential fruits of European integration.

The author critiques the expedient application of market valuation principles by the transnational corporations and other large firms in the Indian pharmaceutical industry on a number of issues like patents, pricing, irrational drugs, clinical trials, etc. He contends that ethics in business is chiseled and etched within the confines of particular social structures of accumulation. An ascendant neo-liberal social structure of accumulation has basically shaped these firms' sharp opposition to the Indian Patents Act, 1970, government administered pricing, etc. The author contends that the practice of neo-liberal economics is strongly associated with a "one dimensional" ethics that privileges market valuation principles over all others. This seems to inevitably generate a social counter-movement that struggles for social protections. He critiques neo-liberal business practices from a perspective that derives from the work of the economic anthropologist Karl Polanyi. Before the present phase of liberalization in India, markets were "managed", but without a "welfare state" in place. Moving toward deregulation of the markets without a welfare state in place is unethical. Keeping the debilities of the institutional framework of public policy in mind, the author adopts a Polanyian perspective that places its trust and hope in the growing social legitimacy of the counter-movement in opposition to both neo-liberal business practices and the degenerate behavior of state agencies.  相似文献

Abstract

This paper presents institutional framework to implement innovative and co-operative procedures of industrial reorganization and economic growth in the Baltic countries. By using the recent features of organization mode theories and institutional economics, we apply how institutional development helps the Baltic firms to survive in the integration of EU25 markets. We present this framework as a dynamic process in three stages. The first stage identifies the main foundations from the transition period: macroeconomic stabilization, privatization, and financial governance. The second stage considers how to build up the institutional structure of the governance in production. The third stage points out those topics that enhance innovation environment and benchmarks the Baltic countries to EU innovation capacity. These progressive stages in financial, production, and innovation systems of governance can be overlapped or happen in sequential order but the final purpose of these improvements is to enhance the managerial incentives for higher innovative activity in the EU-Baltic industrial integration. It is found that the Baltic innovation input capacity is competitive compared with the EU25 average but a gap in innovation output is still essential.  相似文献

There is a need for adjustment primarily in the Central European countries, but also in sensitive areas in the EU itself, particularly the Common Agricultural Policy. Industrial policy is one of the most controversial policy fields. Its scope, instruments and rational vary across countries, changing over time; intentions and outcomes often differ. This volume brings together reports on countries, highlighting specific problems and concepts. Most papers explicitly state that there has recently been renewed interest in industrial policy, be it the new “matrix” approach in the EU, or other strategies in Japan, the US and France. Problems and solutions differ between frontier countries like Finland and the catching-up economies of the new EU member countries, or the policy strategies in developing countries designed to foster economic growth or complement globalisation. The upcoming new approach to industrial policy all hints at a more systemic industrial policy, forward looking and emphasizing the synergies with other policy areas, but also fine-tuning to specific needs, comparative advantages and future technologies.  相似文献
