治理商业贿赂:域外经验与中国实践

改革开放以来,我国在各方面建设取得成就的同时商业贿赂现象也日益严重。经济发达国家在经济高速发展初期也面临着同样现象,但随着社会发展的发展,商业贿赂现象大为减少。为此,有必要结合域外经验与中国实践,采取相应对策以治理商业贿赂。     

中国向商业贿赂说"不"

2005年12月中旬．最高人民检察院、最高人民法院、商务部等部门在天津联合召开了“反商业贿赂与中国社会经济可持续发展研讨会”。与会专家一致认为．商业贿赂已经对中国市场经济体制的运行带来了众多负面的影响，需要强有力的法律遏制。因此．从2006年起，中央将加大力量，把治理商业贿赂作为我国反腐工作的头号重点。     

商业贿赂在中国

主持人语：1月26日，卫生部医疗司的4位司局级干部在会议上被检查机关带走审查，成为政府重拳出击商业贿赂的一个标志性事件。两会期间。治理商业贿赂再次成为热门话题。在此前不久的2月，10天时间里总理曾就商业贿赂的问题进行了两次部署，而中央纪委牵头成立的“反商业贿赂领导小组”成员也由原来的18个部委扩充到22个部委。由此可以看出，商业贿赂已经引起政府的高度重视，而反击商业贿赂也被提高到反腐败的高度。关于惩治商业贿赂的法律，也任不断完善之中。 这种自上而下的反腐机制是否能够有效地惩治商业贿赂？法律是否能够有效地惩治商业贿赂？商业环境如何才能净化？[编者按]     

跨国公司商业贿赂的国际立法和中国刑事法律的完善

跨国公司商业贿赂犯罪具有巨大危害。借鉴治理商业贿赂犯罪的国际经验,完善中国相关刑事法：增设罪名,将财物扩大到财产性利益,加大经济惩罚力度,破解＂攻守联盟＂,实行举证责任倒置。

中国首部反商业贿赂蓝皮书发布1月10日,中国公司法务研究院以及法律及商业资讯服务公司Lexis Nexis律商联讯联合发布"2014-2015中国反商业贿赂调研报告暨中国首部反商业贿赂蓝皮书"。调研发现从企业面临风险大小角度看,民企与国企相对于外企面临着更高的商业贿赂风险;房地产与建筑、快消品与食品等行业是高危行业;企业无论大小都在不同程度上面临着商业贿赂风险的来袭。从风险防控角度看,超过50%的受访企业已建立了反商业贿赂制     

商业贿赂的经济分析

目前商业贿赂行为在全世界都比较普遍,尤其是在中国更是发生了许多起严重的商业贿赂案件,在中国医疗行业和企业项目招投标采购中都存在着商业贿赂,因此,对于商业贿赂的经济分析,研究其产生原因、危害和解决办法就显得尤为迫切了。通过构建理论模型对商业贿赂进行了经济分析,指出了其原因和影响的构成因素,并且具体分析了商业贿赂行为的过程和方式,在此基础上提出了一些解决方法。     

跨国公司“贿赂门”:祸起中国商业潜规则?

客观地说,跨国公司进行商业贿赂也并不是什么新鲜事.然而,值得关注的是,慑于发达经济体的严刑峻法,跨国公司如今已经将商业贿赂的主战场转移到了发展中国家,尤其是像中国这样的新兴经济体.
