In an environment of what would appear to be a widening ‘representation gap’ developing in many organisations, there has been considerable discussion on the effectiveness of non–union employee representation (NER) structures as communication devices and mechanisms for employee involvement, or as a substitute for unions in the collective bargaining process. The underlying debate centres on whether NER forms make trade unions unnecessary, or whether NER forms have a role different from, but complementary to, that of unions at the workplace. The findings of this study suggest that a ‘substitute’ or union avoidance strategy as used at News International Newspapers could have limitations. The implications of not recognising these limitations could result in greater indirect union influence in workplace issues and greater employee dissatisfaction at the workplace.  相似文献

While sector‐level collective bargaining can provide the institutional leverage to sustain and improve employment standards, a proliferation of disorganised local settlements may reduce its effectiveness. This article examines this proposition for local government in the UK, highlights the risks of a ‘destructive’ disorganisation of employment relations and calls for a renewal of articulation mechanisms between sector and local levels of collective bargaining.  相似文献

Most HRM research over recent decades has concentrated on ‘change’, charting ever more fragmented, individualised and unitarist employment relationships. This is equally true of public sector HRM, where the emphasis has been on neo‐liberalism and marketisation. However, in many countries and sectors, collective, pluralist approaches to HRM and industrial relations have proved remarkably resilient. This article uses Neo‐Institutional theory to explain the ‘continuity’ of one such HRM system: national collective bargaining in English local government (1979–2007). We argue that this survives because it manages the political and managerial processes that link central government and central–local relations and acts as a conduit between institutional stakeholders to deliver services to the public. By understanding the ‘passive consensus’ that holds the collectivist HRM system together, we can anticipate the forces that might pull it apart.  相似文献

The Best Value regime, which is being introduced in the UK from April 2000, is rooted in the ‘new public management’ paradigm but also seeks to move beyond it. Like compulsory competitive tendering (CCT) which preceded it, the Best Value framework stresses the role of markets and performance management systems in the provision of public services. However, it appears to offer more scope for local flexibility, and has therefore enjoyed a much higher level of support among local policy makers.

There is though evidence that many in local government have not yet grasped the scale of the improvements in local services that ministers are expecting, and the extent to which this will require changes in existing structures and processes. The result is likely to be an increasingly differentiated pattern of service provision and, in an era of ‘evidence policy making’, researchers are likely to be called upon to develop methodologies which allow evaluation of the alternative models of service provision that begin to emerge.  相似文献

The formal negotiations process remains perhaps the least‐studied moment of collective bargaining. Drawing on ideal types of ‘distributive’ and ‘integrative’ bargaining and the ‘formal/informal’ distinction, this article reports non‐participant observation and ethnographic research into the negotiations process that enabled a change agreement in a British multinational, hereafter anonymised as FMCG. Informal bargaining relations provided the backdrop to—and emerged within—the formal negotiations process. Formal bargaining established new employment contracts based on a simplified internal labour market and generated the joint governance processes to enable and regulate the change process. Neither management nor union strategy was wholly derived from rational, interest‐based positions. The negotiations process was essential to strategy formation and to the emergence of sufficient ‘integrative’ bargaining for all parties to devise and approve new processual institutions and norms to deliver a more flexible labour process and to restore the long‐run viability for ‘distributive’ bargaining.  相似文献

Declining union density, the reduction in coverage or informal derogations from collective agreements are signs of erosion of the corporatist German system of collective bargaining. However, new developments can be observed like ‘unbound’ employers' associations or derogations from collective agreements. These new developments make it necessary to reassess the prospects of collective bargaining. At the first sight they seem to be little more than indicators of erosion or exhaustion, but the in‐depth analysis reveals that these developments can be starting points of renewal because they give stimuli to increase the associational power of employers' associations and, even more important for collective bargaining, unions. As a result, however, collective bargaining will become less corporatist in style.  相似文献

This article reports on the union recognition dispute that took place at the McDonald's food‐processing plant in Moscow. It examines this dispute in the context of McDonald's employment practices worldwide, the interventions made by international and local unions, and Russian government bodies. Despite these interventions it became impossible to either organise the workforce or establish a collective agreement. The case illustrates the difficulties facing both local unions and global union federations when confronted by intransigent multinational companies, especially in low‐skilled sectors in transitional economies.  相似文献

British engineering unions’ campaign for a 35 hour week in 1989–90 was a watershed dispute in terms of strike strategy and its impact on collective bargaining institutions. This article examines the dynamics of the dispute and the tensions between the national and local leaderships of the union campaign and compares it to similar ones waged by the German metalworkers’ union, IG Metall.  相似文献

This article analyses obstacles to transnational union cooperation within Europe. It is based on a survey of unions in 14 European countries and all members of the European Trade Union Confederation. The result shows that ‘hard’ industrial relations factors are generally more important obstacles to transnational cooperation than ‘softer’ factors such as cultural, linguistic, ideological and religious differences and that there are sectoral differences in experiences of obstacles to transnational union cooperation: unions in the manufacturing sector tend to emphasise differences in industrial relations and a lack of organisational resources for transnational union cooperation, whereas low organisational priorities are held to be of more importance in the services sector and for unions for professional workers.  相似文献

Patrick Gunnigle examines management approaches to industrial relations in newly established (‘greenfield’) companies in the Republic of Ireland. He focuses particularly on recent empirical findings on trade union density and recognition and on the role of employer organisations. the evidence presented points to newly emergent patterns of industrial relations management which diverge from the pluralist model. However, in only a minority of cases could these be classified as ‘soft’ human resource management. Indeed a number of organisations studied adopted industrial relations styles which more closely approximated to ‘hard’ HRM. It would appear that the emerging pattern is one of higher individualism and constrained collectivism. the findings also point to the emergence of a vibrant non-union sector among greenfield companies. It is argued that this trend is likely to be accentuated by the increasing number of companies successfully pursuing the non-union route. Equally, the current national industrial policy focus on high technology industries and internationally traded services is also likely to reinforce growth in the non-union sector. A number of factors which may help to arrest this trend are identified, particularly the corporatist structures characteristic of Irish industrial relations and the traditional acceptance of trade unions as legitimate bargaining partners.  相似文献

Since the early 1990s, major reform efforts aimed at reducing industrial conflict, rationalising public sector labour relations, restructuring collective bargaining arrangements, and re-establishing tripartite ‘con-certation’ have transformed Italian industrial relations. This article argues that because these new reforms have been accompanied by significant shifts in both Italy's political system and the unions’ own organisation, they stand a better chance of succeeding than previous reform projects.  相似文献

During the 1990s, outsourcing work was commonly associated with the weakening of union organisation and the deterioration of pay, working conditions and job security. A variant of outsourcing, termed here as ‘insourcing’, involves a firm purchasing ‘non‐core’ functions and services from enterprises located under the same roof. This case study of Fiat outlines the impact of insourcing on traditional arrangements and practices, and analyses the response of Italian local unions. The findings indicate that in the context of ‘bargained compromise’ between trade unions and management in the Italian motor industry insourcing did not have the negative implications for union organisation and employee terms and conditions associated with traditional outsourcing.  相似文献

The contraction of union representation in Britain raises the question of whether or not unions still achieve a wage premium. Analysis of matched employer–employee data from the 1998 Workplace Employee Relations Survey shows that there is now no demonstrable premium for private sector workers in general. However, unions do achieve a wage premium of around 9% for about half of employees covered by collective bargaining arrangements. The effect of union bargaining spills over to other employees in the same workplaces. The paper identifies circumstances where union effects are strongest—employer endorsement of union membership, high collective bargaining coverage and multi-unionism.  相似文献

In this article we analyse some disturbing trends in the Danish labour market: while collective bargaining coverage is still relatively high, union density has been declining and—worse than that—there has been a substantial shift away from recognised and in favour of alternative unionism. The alternative unions are not parties to collective agreements, and they offer membership much cheaper than the recognised unions, in effect taking a free ride on the institutional supports that used to be effective only for the recognised unions. The article explains this conundrum by pointing to the political and institutional backgrounds to this development, which threatens to erode the very basis for the Danish collective bargaining system. On the background of general statistics and of a general employee survey, we point out the reasons behind the challenges confronting the recognised unions, pointing out that the recognised unions must become both more efficient in the member services and more cost efficient, if they wish to halt the present downhill trend.  相似文献

Unions have responded to current membership decline and other organisational problems by restructuring via mergers, increasing union concentration within and across union confederations. A particular noted feature are amalgamations to form ‘super‐unions’. These conglomerate unions threaten to undermine the role played by confederations in respect of political voice, bargaining coordination, and service provision. Despite these mergers, union pluralism still prevails in many European countries with separate peak associations organised along employment/occupational status or political and religious lines. After comparing the recent merger waves and increased union concentration in western European countries, the consequences for union movements are discussed.  相似文献

The concept of countervailing power has been used to suggest that the power of unions explains the origins and development of employers' organisations (EOs). However, unions have declined since the 1970s, but EOs continue to play an important role in employment relations. If pressure from unions is not sufficient to explain continuing employer organisation, what does account for it? This article pursues this question by examining the evolution and activity of UK EOs between the 1960s and 2016. Our countervailing power argument goes beyond a sole focus on unions to include changing pressures and demands on EOs caused by the state such as individual rights legislation and campaigns by civil society organisations. The changing force exerted by these societal pressures helps to explain the shift of EOs' focus from collective bargaining, nowadays only pursued by a minority of EOs, to lobbying, provision of services, legal support, and training.  相似文献

In this paper, I examine an economy where output is produced from labor, capital and public services, and where firms and labor unions bargain over labor conditions and lobby the government over union bargaining power and public services. I compare three institutional cases: (a) competitive wage settlement, (b) bargaining over wages and employment, and (c) bargaining over wages only. I show that in cases (a) and (b) the government expropriates investment rents, but right-to-manage bargaining (c) protects investors from this expropriation.   相似文献

During the last decade, progressive Korean unions have attempted to transform the organisation and bargaining of enterprise unionism into an industrial unionism. This vitalised development in collective bargaining contrasts with trends prevailing in many advanced nations. This paper, on the basis of case studies, examines factors shaping bargaining structures in the context of Korean industrial relations. A theoretical framework regarding factors shaping bargaining structures, one formed in comparative industrial relations studies of advanced nations, proves useful in examining the subject. This finding implies that the attempt of progressive unions will face formidable obstacles.  相似文献
