This article examines the impact of the Canadian constitution, which provides some general fundamental rights, on industrial relations, and concludes that a written constitution encourages judicial legislation to the detriment of workers and their unions.     

高等体育院校体育教育专业毕业生就业问题研究

本文运用文献资料和调查等研究方法,以西安体育学院为例,对其2010和2012届本科体育教育专业毕业生和用人单位进行了调查研究,发现目前体育教育专业毕业生就业现状不容乐观,就业呈多元化趋势,社会对体育教育专业人才规格要求趋向"通用型"、"复合型"。通过调研分析,旨在拓展体育教育专业毕业生的就业渠道和提高就业率,为体育教育专业的人才培养方案和课程体系改革提供参考。

中国与澳大利亚西澳州矿业权管理比较及启示

矿业权问题涉及国家资源利益的实现,是各国矿产资源管理部门共同关心的焦点。澳大利亚是世界上重要的矿产资源生产国和出口国,而西澳州的矿权设置最为明确,相关的矿业制度制定的也比较完善。本文在分析矿业权发展,矿业权设立、管理、流转等基础上,提出完善我国矿业权管理的建议。     

控制权和现金流权分离、财务杠杆与企业投资行为

本文以2006～2009年非金融类上市公司为样本,以控制权和现金流权的分离衡量控股股东和中小股东的代理成本,实证检验了控股股东和中小股东代理冲突对企业投资的影响.研究发现:控制权和现金流权的差值与企业投资显著正相关;相对于其他企业,控制权和现金流权分离的公司财务杠杆与投资的敏感系数更低,高财务杠杆对控制权和现金流权分离与投资的敏感系数无显著影响.本文认为:控股股东和中小股东的代理成本"激励"企业投资行为,而且会弱化负债的治理作用.     

高职物流毕业生就业情况调查与分析

课题组对广州铁路职业技术学院物流管理专业2009届全体毕业生展开调查,调查内容包括两部分：第一部分是学生就业、岗住和能力,第二部分是人才培养目标、课程与能力培养。作者对调查的第一部分做了分析。     

The Economics of Property Rights and Human Rights

A bstract . Human rights and property rights are rights of the person , with the former being numbered among the latter. The property rights school of economics analyzes the impact of maximizing behavior within alternative sets of institutional structures defined in terms of the definition and distribution of property rights. Property rights are tools or parameters, not goals of economic policy in themselves. It is useful to view human rights in the same way. The 'optimal' structure of human rights in an exchange economy , like property rights, depends on the nature of market imperfections such as transactions costs . The views of Rawls, Arrow and Sen can be interpreted in the light of this analysis. It makes a tentative case for some communal human rights (aimed at moderating the effects of an unequal ditribution of resources ) within a system of private human rights vested in individuals rather than the State. This conclusion depends, however, on the distribution of transactions costs in human rights and the chosen role of human rights as tools of public policy.

我国制度财务学是制度经济学在财务领域中广泛应用的结果.财权是企业产权关系运动导致"财"与"物"形成相对分离态势的结果;而企业产权主体对企业的财务活动施加与其产权利益相对应的影响,从而转变成"财权主体";各个财权主体之间的产权博弈关系及其结果就集中反映为企业的财务治理.     

实习大学生的劳动权益保护——以《广东省高等学校学生实习与毕业生就业见习条例》为视角

随着高校扩招和就业压力的增大,大学生在实习期间的劳动权益保护问题成为社会关注的焦点。作为全国首发的《广东省高等学校学生实习与毕业生就业见习条例》在立法上的突破毋庸置疑。本文主要探讨《条例》实施后,实习大学生在劳动权益保护方面仍旧面临的问题,并针对相关问题提出了笔者一些看法。

提要本文首先从我国的教育现状，产业结构和劳动力资源之间的结构性矛盾，来说明发展教育不仅是提高就业质量，扩大就业规模的根本途径，同时也是实现包括教育公平、就业公平在内的社会公平的内在要求；其次从提高教育效益，促进就业发展的角度提出政策建议，以供参考。     

The Legal, Ethical, and Managerial Implications of the Neutral Employment Reference Policy

The litigious environment surrounding employers today has caused them to be overly fearful of providing candid yet adverse employment references. Their attempts to minimize litigation risk created by the dismissal of a vindictive employee have clouded their judgment when asked to assist in the dissemination of employee information. This is alarmingly illustrated by the growing number of employers who have blindly adopted a neutral reference policy. Unfortunately, indiscriminate application of this policy will not necessarily preclude litigation, but, rather, foster it. It is imperative that employers carefully weigh the tangible and intangible costs of a reference defamation suit against their duty legally, ethically, and managerially to disclose vital information about a former employee.
