In the last few years, digital constitutionalism has emerged as a novel, alternative, Internet Governance approach aiming at ordering and limiting the exercise of power by both states and private operators, as well as at promoting people's control over digital technology development.Although digital constitutionalism is encountering growing popularity, the prevalent non-binding nature of its initiatives, the discrepancy between the jurisdictional border and transnational digital processes, and the technological embedment of governance mechanisms, have hindered the effectiveness of its impact.This paper identifies epistemic communities as a crucial factor for the constitutionalization of the digital technologies since they have the necessary technical expertise and policy commitment to create norms and standards at transnational level, informing the policy choices of both state and non-state actors.In order to illustrate this nexus, the article performs an in-depth investigation on the case of the European Commission High-Level Expert Group on Artificial Intelligence (HLEG-AI). The analysis revealed that the HLEG-AI effectively gathered an epistemic community strongly committed with fundamental rights promotion and capable to influence the following policy-making activities of the European Commission, as well as of other non-state stakeholders, whose involvement is essential in order to embed digital constitutionalism principles within the design of AI systems. 相似文献

This study analyzes the influence of a number of variables on the ethical decision making process of South African marketers. Specifically, it measures the relative influences of ethical perception, idealism, relativism, and corporate ethical values on the ethical intentions of the marketers. The target respondents were practitioner members of the South African Institute of Marketing Management. The survey results indicate that perception of an ethical problem and relativism are significant predictors of ethical intentions, as hypothesized. The other two predictor variables (idealism and corporate ethical values) were not significant. The results regarding idealism are generally consistent with those from previous studies, but corporate ethical values has usually been found to be significant, and not just in the United States. In this paper we show that highly skilled clandestine migrants are more likely to return home than migrants with low or no skills when illegality causes "skill waste", i.e. when illegality reduces the rate of return of individual capabilities (i.e. skills and human capital) in the country of destination. In a simple life-cycle framework, illegality is modeled as a tax on skills that reduces the opportunity cost of returning home particularly for the highly skilled. This proposition is tested on a sample of apprehended immigrants that unlawfully crossed the Italian borders in 2003. The estimation confirms that the intention to return to the home country is more likely for highly skilled illegal immigrants. The empirical results of this paper attenuate the common wisdom on the return decisions of legal migrants, according to which low-skill individuals are more likely to go back home (mainly because of negative self-selection). 相似文献

Proper hazard identification (HAZID) in safety reports has become progressively more difficult to achieve. Several major accidents in Europe in recent years, such as Buncefield and Toulouse, were not even considered by their site ‘Seveso-II’ Safety Case. One of the reasons is that available HAZID methodologies take no notice of apparently least likely events. Nonidentified scenarios thus constitute a latent risk, whose management is extremely complex and open ended. For this reason, the EC project iNTeg-Risk, in one of its tasks, aimed to investigate the issue of atypical scenarios and explain how they could have been identified. This study wants to describe the approach used and its immediate results, paving the way towards a new method for the identification of atypical accident scenarios. An in-depth accident analysis of some of these accidents was performed, in order to outline general features of plants in which they occurred, their causes, consequences, and lessons learned. This analysis followed a precise common scheme, which allowed a systematic approach to the problem by the experts involved. Based on the findings, failures connected to risk management and risk appraisal were identified. Three main basic issues in risk appraisal were identified: the low perception of emerging risks related to atypical accident scenarios, the lack of knowledge about related events, such as early warnings, and the incapability of current techniques in leading analysts to the identification of atypical scenarios. 相似文献

We provide sufficient conditions for the validity of the first-order approach for two-period dynamic moral hazard problems where the agent can save and borrow secretly. The first-order approach is valid if the following conditions hold: (i) the agent has non-increasing absolute risk aversion utility (NIARA), (ii) the output technology has monotone likelihood ratios (MLR), and (iii) the distribution function of output is log-convex in effort (LCDF). The paper addresses the reduction of the total cost of purchasing in public procurement, focusing on tenders called for in the European Union and awarded by the Lowest Price (LP) criterion. Taking into account the main characteristic features of governmental purchasing (competition, prescribed procedures, and transparency) and building upon the related contributions in the literature, we present a probabilistic approach for evaluating and limiting the total cost of purchasing in public tenders awarded according to the LP criterion. The presented framework includes the evaluation of the so-called additional costs of purchasing (ACP), a part of the transaction cost that is typically considered in the related literature from a private organization perspective only. The approach can be applied to a generic transaction in any public tender issued according to the European legislation with the LP criterion. Considering the real case study of the public tender for maintenance works on a municipal sport facility in Bari (Italy), we take into account the costs of both transaction counterparts, i.e., the ACP regarding the contracting authority and those related to the firms involved in the tender. Applying the model to the case study, we underline the relevance of ACP for public tenders and show that, by inviting a suitable number of bidders to participate in the call, it is possible to save money both for the contracting authority and the involved competitors. 相似文献

We use national labor force surveys from 1983 to 2015 to construct hours worked per person on the aggregate level and for different demographic groups for 18 European countries and the United States. We apply a harmonization procedure to measure hours worked consistently across countries and over time. In the recent cross‐section, Europeans work 14 percent fewer hours than US Americans. Differences in weeks worked and in the educational composition each account for one quarter to one half of this gap. In addition, lower hours worked per person than in the United States are driven by lower weekly hours worked in Scandinavia and Western Europe, but by lower employment rates in Eastern and Southern Europe. 相似文献

This study addresses the Supply Chain Finance challenge of Commodity Price Volatility (CPV) by adopting a supply chain-oriented perspective. In particular, the effectiveness of two Supply Chain Risk Management (SCRM) strategies in mitigating CPV, namely, Switching suppliers and Substituting Commodities, and the main factors that may affect their value, are investigated with a simulation analysis. A Real Option Valuation (ROV) model was developed and tested on real cases of CPV mitigation, as experienced by a large multinational company (Fortune 100) leader in the Fast Moving Consumer Goods (FMCG) industry. The results show the effectiveness of Switching suppliers and Substituting Commodities in mitigating CPV, highlighting that the convenience of adopting such strategies is strongly influenced by some specific conditions, like the relative values of the long-term prices of the commodities, the purchasing volume, and the sunk cost needed to build flexibility. 相似文献
