In federal systems the courts are accorded the important role of policing the boundaries of the constitutionally specified powers given to the legislature and the executive. The devolution statutes enacted by the UK parliament have created a semi-federal system, in which the courts increasingly have been called upon to adjudicate on whether sub-national legislative bodies have acted ultra vires. Following a comparative overview of the theory and practice of court adjudication in overseas systems of multi-level governance, the leading cases of the British Supreme Court and the House of Lords are considered. It is proposed that Britain—almost by default—has become a semi-federal court somewhat akin to the US Supreme Court and the German Bundesverfassungsgericht.  相似文献

Bonus distribution in enterprises or course allocation at universities are examples of sensitive multi-unit assignment problems, where a set of resources is to be allocated among a set of agents having multi-unit demands. Automatic processes exist, based on quantitative information, for example bids or preference ranking, or even on lotteries. In sensitive cases, however, decisions are taken by persons also using qualitative information. At present, no multi-unit assignment system supports both quantitative and qualitative information. In this paper, we propose MUAP-LIS, an interactive process for multi-assignment problems where, in addition to bids and preferences, agents can give arguments to motivate their choices. Bids are used to automatically make pre-assignments, qualitative arguments and preferences help decision makers break ties in a founded way. A group decision support system, based on Logical Information Systems, allows decision makers to handle bids, arguments and preferences in a unified interface. We say that a process is p-equitable for a property p if all agents satisfying p are treated equally. We formally demonstrate that MUAP-LIS is p-equitable for a number of properties on bids, arguments and preferences. It is also Pareto-efficient and Gale–Shapley-stable with respect to bids. A successful course allocation case study is reported. It spans over two university years. The decision makers were confident about the process and the resulting assignment. Furthermore, the students, even the ones who did not get all their wishes, found the process to be equitable.  相似文献

Environmental justice principles are widespread at national and global levels of transition discourse, but this is sometimes irrelevant to marginalized communities. To address this issue, we apply environmental justice theory to a participatory postcolonial urban case study where poverty, unemployment and inequality continue to incentivize unregulated exploitation of vulnerable environments and people. It is unclear how national legislation can provide for indiscriminate access to environments that promote wellbeing in complex postcolonial communities, where xenophobic and economic discrimination reproduces colonial-style inequalities. To resist this injustice, the combination of academic and ordinary expressions of critique that confront regressive praxis and orthodoxies becomes a valuable and constructive political innovation for transitions. Empirical results suggest that enfranchising the most vulnerable proponents of transformation could advance their political capital to advocate for themselves, formulate and enculturate decolonized visions of urban sustainability, demand governmental and commercial accountability and foster urban reform that is relevant to them.  相似文献

Economic opportunity in the United States is shaped by parental health and disability. We hypothesize that Disability Insurance (DI) may mitigate the observed pattern. Using linked survey and administrative data, we find children of work-limited parents have 4.1 percentiles less upward economic mobility and 4.3 percentiles more downward mobility relative to children of non-limited parents. Despite poorer health, children of parents initially awarded DI experience a negligible mobility gap relative to peers whose parents never apply to DI and 3.6 percentiles more upward mobility than peers of parents who are initially denied benefits—suggesting DI may moderate economic mobility.  相似文献

GoFundMe, founded in 2010, has already profoundly impacted giving practices, introducing many laypersons to the empowering potentials and user-friendly affordances of peer-to-peer fundraising. Overall, GoFundMe's extraordinary success as a for-profit company in traditionally nonprofit charitable giving markets can be attributed to: normalizing their platform as the go-to destination for people seeking help; tasking the beneficiaries themselves with crafting appeals for support; restricting forms of support to money; deferring responsibility to donors to assess the legitimacy of appeals; and dominating the market by acquiring competitors and pursuing growth wherever possible. No charity could plausibly adopt such an operating model and GoFundMe's lean, hands-off, self-policing approach has attracted sharp criticism over the years. Nonetheless, the company has not humbly reined in their ambition but expanded it even further. This paper outlines three broad phases through which GoFundMe has defended their capture of “the giving layer of the internet.” Initially, GoFundMe espoused ideals of utopian disruption and soteriological solutionism, selling their platform as a “take-action button” and user-friendly means of empowering everyday citizens to improve the lives of others. Later, after attracting more divisive causes and criticisms of its revenue model, GoFundMe adopted forms of reputational repair and attempted neutrality, insisting that their for-profit platform could be accommodative to all worldviews and persons willing to embrace “positive precarization.” More recently, as “neutral” stances became untenable and fundraising success rates increasingly grim, GoFundMe pivoted toward strategies of state critique and civic capture. Specifically, GoFundMe have: more pointedly highlighted state failures; actively aligned themselves with social movements; shifted away from relying solely on peer-to-peer fundraising; and instead partnered more with established nonprofits. However, as GoFundMe's expansion inevitably means becoming entangled in sensitive political matters, the company's ambition to become the key intermediary in all charitable giving is facing acute challenges.  相似文献

We introduce country-level Google search activity as a direct measure of the level of stakeholder attention directed towards sustainability reports. We validate this measure by establishing that search activity for sustainability reports is correlated with temporal patterns in firms' supply of these reports. To frame the economic magnitude of this search behaviour, we then show that the level of attention directed towards sustainability reports is very low compared to the level of attention directed towards financial and accounting information. Next, we examine two related research questions. First, we identify who pays attention to sustainability reports. We find, consistent with the environmental Kuznets curve, that attention towards sustainability reports is strongly associated with economic development. Consistent with findings in prior research that suggest citizens in stakeholder-oriented countries have stronger preferences for firms to act prosocially, we also find that search activity for sustainability reports relative to search activity for financial performance metrics is greater in civil law countries than in common law countries. Finally, we then explore the question of why individuals pay attention to sustainability reports and find evidence that suggests sustainability reports are used for two primary purposes: evaluating the societal impacts of firms' actions; and, firm valuation.  相似文献
