员工关系管理理论综述

国内外企业经营管理实践证明，和谐的员工关系不仅能帮助企业赢得人才、留住人才，而且可以使企业管理和业务的运作效率大幅提升，从而更有效的实现企业的经营目标。文章对国内外员工关系管理的研究进展及成果进行了一定的综述，并在此基础上对符合我国国情的员工关系管理做出了一些探讨。最后，文章对员工关系管理需要进一步深入研究的问题提出了几点看法。

国资监督机构在深化国资国企过程中应集中调配产权权益,完善资产负债结构,优化资源配置,通过资本运营和良好的市场环境,充分发挥中央和地方政府的职能,在互为尊重的前提下,杜绝侵权行为的发生。     

Land Reform: Taking a Long(er) View

The paper proposes a broad argument that the end of state–led development from the 1970s coincided with (i) the final wave of major redistributive land reform, and its place within transitions to capitalism, that lasted from about 1910 to the 1970s, and (ii) the beginnings of contemporary 'globalization'. Self–styled 'new wave' agrarian reform in the age of neo–liberalism, centred on property rights, is unlikely to deliver much on its claims to both stimulate agricultural productivity and reduce rural poverty. The reasons are grounded in the basic relations and dynamics of capitalism, and how these are intensified and reshaped by and through globalization. Understanding these processes, with all their inevitable unevenness, requires (i) recognizing that the historical conditions of the 'classic' agrarian question no longer apply, and (ii) developing the means to investigate and understand better the changing realities facing different agrarian classes within a general tendency to the concentration of capital and fragmentation of labour, including how the latter may generate new agrarian questions of labour.

本文试图对商业流通企业中存在的两种寄存包行为的行为性质进行法律分析,并对此引起的法律责任,产生的法律后果作一理论上的探讨,以求正确界定它们,保护消费者与商业企业的合法权益。     

论商标反向假冒行为及其法律规制

商标反向假冒行为妨碍了他人对自己商标的正常使用，扰乱了正常的市场秩序，欺骗了广大消费者和公众。很多国家的立法都明文对其进行规制，我国现行法律亦从不同角度对其进行规制。当前，对严重的商标反向假冒行为，应予以刑法调整。     

Aggregate Dividend Behavior and Permanent Earnings Hypothesis

The study examines the aggregate dividend behavior of U.S. corporations based on the permanent earnings hypothesis. Using annual data of aggregate earnings and dividends from 1871–1993, I find that although managers change dividends proportional to permanent earnings changes, they make revisions with a larger percentage change in dividends than in permanent earnings. The results from the post‐war data show that firms follow a partial adjustment policy with a long‐term dividend payout target in mind and make revisions with a delay. The quarterly data analysis yields results similar to those of the post‐war annual data.     

Marriage Settlements

French couples may choose between two types of marriage settlements governing asset ownership after a divorce or inheritance: common property or separate property. A cooperative model considers the marriage contract as a means of providing for widowhood of the less endowed spouse. A second model addresses the probability of divorce and the production of a marriage good. The common property contract then becomes a means of inducing the wife to invest in the marriage good. Choice of contract, labor supply and fertility are simultaneous. Empirically we find that characteristics of the spouses such as relative age or differences in endowments influence the choice. So do the expected number of children and the wife's labor supply decision. This last decision is also shown to be influenced by the chosen settlement, while fertility is not.

中国加入世贸组织后外贸管理体系变化研究

中国自改革开放至加入WTO,外贸法规、政策发生了很大变化,与过去相比,正向更加标准、更加透明方向迈进,逐渐接近国际标准.但目前中国外贸法体系及与之相关的实施细则有待于修正和完善,进一步适应WTO规范.     

Property Rights Reform in Rangeland China: Dilemmas On the Road to the Household Ranch

This paper contributes to the debate over land tenure in rural China by extending its spatial coverage to the country’s extensive rangeland regions. Key characteristics of pastoral tenure, identified from field appraisals in western China, include group tenure and fuzzy boundaries. Although these characteristics give rise to efficiency concerns, from a new institutional economics perspective they also facilitate the realization of certain benefits, benefits that could represent opportunity costs of further exclusiveness. The strengthening of rangeland co-management may constitute a more appropriate path to institutional improvement than the establishment of the household ranch, the current goal of national rangeland policy.
