司法公正观新议——人身危险性进入司法领域对传统公正观念的冲击

人身危险性是量刑的重要根据之一。对具体犯罪人适用轻重不同的刑罚时,必须在考虑行为的社会危害性的基础上,充分考虑行为人的人身危险性。这不仅是实现特殊预防的刑罚目的的需要,而且是实现量刑公正的需要,人身危险性是量刑公正的调节器。人身危险性进入司法领域造成的"同罪异罚"必将严重冲击传统的司法公正观念。

Internationalizing the Assessment Criteria to Build Cross-Cultural Competency

ABSTRACT

International business programs, universities with international students, and educators who seek to internationalize their teaching need to make informed decisions about teaching, testing, and assessment criteria. The infusion of American business curricula throughout the world as well as the need to train American business students for leadership roles in global contexts calls for teaching and assessment practices which explore a plurality of cognitive, affective and behavioral pedagogical strategies. This article considers traditional education and assessment in China in light of American educational practices currently used for assessment in business training. It explores how an understanding of modern Confucianist values can shape assessment choices in both American and overseas programs as an example of developing cross-cultural awareness. The authors call for an assessment process in business education which draws from a plurality of methods adapted to teaching, learning and testing for global awareness.     

Perceptions of Workplace Spirituality among Professionals and Executives

As a new century begins, it is becoming increasingly clear that workers are experiencing a fundamental change of business world values, a change of paradigms as radical as the Age of Information. Corporate America and its employees are responding to a call for a deeper sense of purpose, a more significant sense of faith, and a renewed commitment to spirituality. This paper reports research that focuses on the relationship among the 3 key stakeholders in this new emphasis on spirituality: individual, organization, and work unit. Significant correlations were found to exist among 3 factors of spirituality and among 11 variables that were submeasures of the factors.

与经济全球化相伴随的文化全球化必然会引发同民族本土文化的价值冲突,影响到当代青年文化价值观的建设。因此,正视和承认全球化背景下价值观念的多样化态势,坚持正确的价值导向,科学地构建价值冲突的调适机制,才能发展民族本土文化,建设社会主义新文化。     

Is There Any Change in the Public Service Values of Different Generations of Public Administrators? The Case of Turkish Governors and District Governors

In recent public administration literature, much attention is paid to changes in public service values, including ethical values, that guide public service. This paper reports on the results of an empirical survey conducted among a group of Turkish governors and district governors (including those in service and retired) who are from different generations. By focusing on the transformation of value preferences of Turkish governors and district governors, this study tries to identify variations in values, particularly about public service ethics, in accordance with the age and the length of tenure in public service. The findings of the research show a traditional and more or less consistent value pattern for Turkish governors and district governors. The most important public service values expressed by the respondents are consistent with often-mentioned crucial public service values in the literature. New or emerging values have not been present enough among the most important public service values. In brief, the results do not lend support to the often-assumed hypothesis that traditional public service values are devaluated or degraded by the emergence of businesslike values. In other words, new emerging values could not sneak into the public service culture in any convincing manner in spite of many years of NPM rhetoric and recipes.

The value of project management to organizations in Canada and Germany,or do values add value? Five case studies

Five case studies have been conducted: four in Canada and one in Germany. The authors of this article were particularly interested in understanding the value of values and meaning in the context of project management implementation and project environments. The article first summarizes the authors' particular approach. It then discusses the five case studies and their findings. These findings will be grouped around the concepts of value of project management and meaningful work. In conclusion, the findings of this study will be summarized across all five case studies and based on a comparative content analysis.

Spatial Economic Analysis in Data‐Rich Environments

Controlling for spatial effects in micro‐level studies of consumer and producer behaviour necessitates a range of analytical modifications. These range from modest changes in data collection and the definition of variables to dramatic changes in the modelling of consumer and producer decision‐making. This paper discusses conceptual, empirical and data issues involved in modelling the spatial aspects of economic behaviour in data‐rich environments. Attention is given to established and emerging agricultural economic applications of spatial data and spatial econometric methods at the micro‐scale. Recent applications of individual and household data are featured, including models of land‐use change at the urban–rural interface, agricultural land values, and technological change and technology adoption.
