以生产者为主的责任延伸制度新探——有感于《中华人民共和国循环经济法草案征求意见稿》

以《循环经济法草案征求意见稿》第17条规定的以生产者为主的责任延伸制度为基点,分析了以生产者为主的责任延伸制度的内涵、弊端及其实施的保障机制,指出以生产者为主的生产责任延伸制度的主体应包含政府,责任形式应增加行政责任和刑事责任,并对保障机制加以分类,具体阐述了生命周期评价制度、认证单制度、产品回收制度、监督制度、抵押制度等。     

创业投资机构对其支持企业IPO抑价度的影响

本文介绍了国外关于创业投资机构如何影响企业IPO抑价度的主要理论,在此基础上以我国的中小企业板上市公司为研究对象,通过比较分析发现与非创投支持企业相比创投支持企业有着更高的抑价度,进一步地研究表明该现象可用Am it et.al.[1]提出的逆向选择理论来解释。

提高石油企业质量体系认证的有效性

指出提高质量体系认证的有生应从以下两方面入手：首先要提高质量体系的有效性，应从质量体系的建立、宣贯、实施、保持、完善等五个方面作细致的工作，并且还要搞好内审及管理评审；其次要提高认证工作的有效性，要选择适合石油企业的认证公司，还要求认证公司要有熟悉石油相关专业的审核员及技术专家，认证公司要有一定的知名度及敬业精神，能为认证的企业负责，使认证企业的质量体系逐渐完善和提高。     

建立和运行一体化管理体系的初步尝试

对质量管理体系、环境管理体系、职业健康安全管理体系进行合理整合，形成一个综合管理体系即QEO一体化管理体系。认为：QEO一体化管理体系是建立方针和目标并实现这些目标的相互关联或相互作用的一组要素、组织机构、管理、程序过程和资源，它比多个管理体系更能有效达到依据方针所制定的目标。详细介绍了建立QEO一体化管理体系的过程。     

试论强化我国地理标志的法律保护——以法国香槟酒行业委员会与商标评审委员会商标争议纠纷为引

随着经济的发展,人们越来越重视地理标志在市场竞争中的作用。各国均在法律层面对地理标志予以保护,并采用不同的立法模式。我国表现为结合运用《商标法》和《地理标志产品保护规定》来保护地理标志。但从实践来看,此种方式尚存在缺陷。在最新修订的《商标法》中也没有提出将地理标志区分于其他标志而给予针对性的规定。为了进一步发挥其在国际竞争中的经济价值,我国应当给予地理标志更大力度的保护。     

Land tenure insecurity in post-certification Amhara,Ethiopia

It is generally believed that tenure security has improved due to the programme of land certification. In this paper I argue the opposite. Tenure security concerns three different rights: possession, renting and latent rights. Rights of possession are believed to have improved, but the evidence is weak and conflicting. Land rentals are expanding and farmers face high tenure insecurity. The main problem, though, is latent rights, with great insecurity and increased conflict levels. Despite rapid economic development there is considerable social malaise, an unfortunate agricultural structure, and considerable pressure for land redistribution due to unresolved land tenure issues. The paper is based on the certification literature and primary material from North Shäwa.     

森林认证标识认知影响因素的实证分析——基于北京市488名消费者的调查

依据2014年8~10月对北京市488名消费者的问卷调查资料,运用二元因变量的Logistic回归模型,对影响消费者对森林认证标识认知的因素进行了实证分析。结果表明:影响消费者对森林认证标识认知的主要因素是职业、对森林状况的了解、信息渠道和通常对于标识的信任度。最后就如何提高消费者对森林认证标识的认知水平和信任程度给出了加大对森林认证及其标识的宣传力度;充分利用多种宣传渠道展开对森林认证及其标识的宣传;增强国人的森林资源危机意识;更多地组织保护森林资源的活动;积极开拓国内森林认证产品市场;加大对森林认证产品的监督管理;消费者应增强自身的环保意识、绿色消费意识和责任意识等建议。     

Pains and gains of environmental management system certification for the sustainable development of manufacturing companies: Heterogeneous effects of industry peer learning

Environmental sustainability is a growing global concern. Environmental management systems (EMS) could be an effective strategic tool to help firms deal with their sustainable development. However, whether EMS certification pays off financially and how it takes effect can be debated. Thus far, these questions remain largely under‐researched. In particular, the effects of EMS certification on financial performance are inconclusive, and the reasons explaining the effects are underdeveloped. This study aims to enrich the current research by exploring the mediating and moderating roles from the perspective of cost‐efficiency trade‐offs to reveal how EMS certification affects financial performance. Applying a PROCESS procedure analysis and causal mediation analysis to a sample of 1,751 Chinese listed manufacturing firms from 2008 to 2016, this study shows that the effect of EMS certification on firms' financial performance is insignificant because their operating costs burden increases while their marketing efficiency and managerial efficiency improve. For the first time, this study demonstrates the moderating role of industry peer learning, as the mediating effects decrease with the growth of industry peer learning.
