少年司法福利化改革视野下的少年检察制度

目前国内关于少年审判和少年法庭方面的理论研究颇多,成果颇丰,但对于少年检察制度的研究与实践推动还远远不够,正如有学者指出的那样:作为少年司法制度的重要组成部分,我国未成年人检察制度还远远没有完善到只需要墨守成规的时候,当前,必须加快少年检察制度的探索与改革。①而对少年检察的改革和完善,首先要明确其职能定位和价值取向,才能构建科学完整的少年检察制度。本文通过比较分析少年司法制度所适用的价值选择,确定少年检察制度的职能定位,从而为构建我国的少年检察制度提供理论依据。

The Significant Variations about the 《Unicom Customs and Practice for Documentary Credit》 in UCP600 and the Impact to the Parties

At the present, there are many problems during the period of execution of the UCP500 in the practice, and its contents have already failed to follow the variations of the reality. It seems that such customs cannot be in accordance with the improvement at the times because of lots of cases related to the UCP 500.

It seems that such customs cannot be in accordance with the improvement at the times because of lots of cases related to the UCP 500.In the period of the modification of the UCP500,the ICC adopted the reasonable terms of all kinds of relevant publications ,opinions and decisions which were issued by ICC after UCP500 coming into execution. In fact,UCP600 actually represents the changes in the modern international banking,transportation business and the insurance industry.
