美国专利法域外适用制度:流变、适用与启示

专利权被认为是最具有领土性的权利,长期以来,专利保护的国内立法和国际条约均未突破专利权的地域性.随着专利跨国保护重要性与专利权地域性的矛盾日益突出,在美国专利权人的游说下,美国国会不断修订专利法,赋予部分规则域外效力以规制境外组装、境外制造等境外行为;同时,美国法院在司法实践中对这些规则的界限和范围表现出不确定性.但总体而言,这些规则的实践进一步实现了美国专利权人维权与竞争的双重功能,起到促进美国专利创新与维护国家利益的作用.中国处于从专利引进大国向创造大国转变的特殊时期,立法上应未雨绸缪确立适度的符合中国现实的专利权保护域外规则,同时应注意积极调动私人能动作用和发挥法院的积极作用.

清徐县优势农业与旅游业协调发展研究

[目的]发展优势农业是改造传统农业,加快农业现代化的有效途径之一,旅游业作为国民经济新的增长点,两者协调发展更有利于增加农民收入,促进新农村建设,同时也是农村社会经济可持续发展的必然要求。[方法]文章通过文献查阅法了解清徐县优势农业葡萄及葡萄文化旅游业等方面的相关研究及研究成果,结合实证分析法通过协调发展度函数构建模型对清徐优势农业协调旅游业发展进行定量分析。[结果]清徐县优势农业和旅游业的综合评价指数从2004年的0.118 6上升到2016年的0.985 8,总体呈上升趋势,同时协调度13年间,2004~2008年介于0.221 5~0.490 5之间,处于失调发展阶段,2009年为过渡阶段,协调度为0.524 3,2010~2015年协调度介于0.626 7~0.685 8之间,处于初级协调发展水平,2016年协调度为0.701 7,发展到中级协调发展水平。优势农业与旅游业协调发展有利于区域经济水平的提高和农业收入的增加。[结论]推动优势农业与旅游业协调发展,清徐县需加大散户经营管理力度,切实有效地解决散户存在的实际问题,夯实优势农业的基础,为旅游业发展提供更大的发展空间。     

Collaboration for R&D Projects between the Industry and External Agents: Evidence from Manufacturing Companies in Peru

In this article we use the innovation survey of the manufacturing industry of Peru to identify cooperation behaviors for research and development (R&D) projects among companies and external agents in general. Likewise, we also find cooperation behaviors among the industry and the following external agents: university, technical centers, suppliers, customers, and companies of the same group, competitors, guilds, and consultants. Within the specific agents, the university is considered a cooperation agent for R&D projects. We use the survey of innovation in the manufacturing industry of Peru conducted in 2015, which resulted in 1447 Peruvian companies being surveyed. Evidence was obtained as to the degree of the tie between the industry and external agents for cooperation in R&D projects, giving relevance to variables such as investment, resources, and degree of innovation. Our results show that investment is an important factor for cooperation with external agents. Additionally, companies that have innovated at some point seek to cooperate with external agents. Finally, the importance of the university is demonstrable, thus, companies that invest in R&D seek to cooperate with the university.     

CONTINUOUS PREFERENCE ORDERINGS REPRESENTABLE BY UTILITY FUNCTIONS

This paper surveys the conditions under which it is possible to represent a continuous preference ordering using utility functions. We start with a historical perspective on the notions of utility and preferences, continue by defining the mathematical concepts employed in this literature, and then list several key contributions to the topic of representability. These contributions concern both the preference orderings and the spaces where they are defined. For any continuous preference ordering, we show the need for separability and the sufficiency of connectedness and separability, or second countability, of the space where it is defined. We emphasize the need for separability by showing that in any nonseparable metric space, there are continuous preference orderings without utility representation. However, by reinforcing connectedness, we show that countably boundedness of the preference ordering is a necessary and sufficient condition for the existence of a (continuous) utility representation. Finally, we discuss the special case of strictly monotonic preferences.
