我国于1999年通过《个人独资企业法》，该法颁布后并未出现人们期待的个人独资企业迅猛发展的现象。虽然有诸多原因，但个人独资企业法律制度自身规定的不完善应是主要原因。因此完善该制度就成了一种现实的选择。

Does seeing more deeply into a game increase one’s chances of winning?

The substantively rational value of the games studied in this paper does not help predict subject performance in the experiment at all. An accurate model must account for the cognitive ability of the people playing the game. This paper investigates whether the variation in measured rationality bounds is correlated with the probability of winning when playing against another person in games that exceed both players’ estimated rationality bound. Does seeing deeper into a game matter when neither player can see to the end of the game? Subjects with higher measured bounds win 63 percent of the time and the larger the difference the more frequently they win.     

Limit-pricing as Bertrand equilibrium

Summary. We consider a Bertrand duopoly model with increasing returns to scale where one of the firms have a cost advantage and prices vary over a grid. We find that typically more than one equilibria exist. However, there are only two perfect equilibria. Moreover, as the size of the grid becomes small, both these equilibria converge to the limit-pricing outcome. Received: February 25, 2000; revised version: January 9, 2001

经研究发现 ,张维迎教授在 2 0 0 1年第五版的《博弈论与信息经济学》中所借用的承诺要胁诉讼博弈例子中对诉讼费用的处理有点不妥 ,便作出了适当的调整 ,但却得出了令人沮丧的结论 :承诺要胁诉讼不成立 !继续研究发现只有打破这种败诉风险由当事人承担的机制 ,才能传递出有力量的信号 ,才能做到真正的威胁 ,那就是建立“生死与共”的竞争性的律师定价机制和保费率真正是胜诉率信号的诉讼费用保险机制与最经济的诉讼程序与非诉讼程序、保障其实现的机制和可供的备选机制。本文论证了其合理性     

为在我国建立起完善的税收制度而积极改革

建立比较完善的税收制度至少应体现五点特征 :(1)不同所有制税收政策必须是同一的 ;(2 )涉外税收必须有利于我国参与经济全球化 ;(3)税制基本构架必须符合中国基本国情 ;(4)能较好地发挥对收入分配社会调节器作用 ;(5 )有利于发展经济、激活企业 ,轻徭薄赋。并要解决好四个理论问题 :(1)坚持“双主体”理论 ;(2 )实施国民待遇、一视同仁原则 ;(3)如何正确处理中央与地方关系 ;(4)正确确定税收调节“基点” ,方法上要综合设计、稳中求进、分步实施。     

政府公共工程招投标腐败举报研究

政府公共工程招投标领域内,参与投标人为达到自身的某种目的常常采取行贿等非法手段。这种腐败违法行为不仅严重败坏了社会风气,且给政府公共工程建设带来极大破坏。消除这种行为,除了需要相应的监管部门付出很多努力外,与招投标违法举报人的举报积极性密切相关,举报人提供的线索在查处腐败案件中起关键的作用。充分发挥举报人的积极性,是查处腐败案件的重要突破口,也是做好工程建设预防寻租腐败等发生的重点和难点。该文从政府公共工程招投标腐败举报问题出发。从举报人是否属于当事人的角度进行分类,研究了它们的异同点,并对举报人与被举报人之间利益进行博弈分析,在此基础上提出了完善政府公共工程招投标腐败举报制度的途径。得出结论是,提高举报人积极性的努力方向有两条：其一是降低举报人的举报风险;此外就是增加举报人在举报活动中的预期收益。     

Remittances as a social status signaling device

Like all human beings, migrants may have a concern about their prestige or social status in the eyes of left-home family and friends. They can remit money in order to signal their economic success and increase their status. We show that if migrants’ income is private information, unsuccessful migrants might accept a worsening of their living conditions and send back home large amounts of remittances only in order to make residents believe that they are successful. In some cases, successful migrants can signal their true favorable economic situation by remitting an even larger amount. The game presents various equilibria that differ with respect to the proportion and nature of the migrants who sacrifice consumption opportunities to status revealing actions.
