Incorporation and Company Formation in Australasia, 1790–1860

Nearly 260 companies were founded in and for the Australasian colonies between 1790 and 1860. A quantitative survey suggests that the patterns of incorporation mainly reflected ‘functionalist’ economic factors rather than ‘autonomous’ legal conditions, though the changing nature of company law did influence the various forms that incorporation took. In some sectors, outside factors and even historical accidents also pushed patterns of incorporation along distinct lines. The result was a tradition of adapting legal powers of incorporation to local needs which persisted beyond the introduction of modern company acts to the region in the 1860s and therefore shaped the subsequent evolution of the company in Australia and New Zealand.     

趋同的城乡生育意愿对生育政策调整的启示--基于北京市城乡独生子女生育意愿的比较研究

对北京市2006年和2008年的城乡独生子女生育意愿作了调查。在我国经济社会较为发达地区,城乡独生子女的生育意愿无论在生育数量还是在子女性别偏好和生育时间上都存在趋同的现象。对目前各省市在生育政策调整时城市和农村依然采取不同政策的做法提出看法。在经济社会较为发达的省市,可以推行城乡一体化的生育政策。     

我国应确立公司设立无效制度

公司设立无效制度是外国公司法的一项重要制度,为受侵害的当事人提供了一条司法救济途径.通过对公司设立无效的内涵、外国立法例、法律类型的分析,提出确认设立无效的法律途径,并针对公司设立无效可能带来的负面效应提出了相应限制和矫正措施,以期对我公司立法有所助益.

加入WTO使我国原有的银行市场垄断格局被逐渐打破 ,市场被重新分割 ,客户被重新组合 ,并由此促进我国商业银行“营销致胜”理念的形成 ,加快中外资商业银行营销融合 ,改善我国银行营销环境 ,提升我国商业银行营销管理水平。     

Leisure and Consumer Culture in Japan

This paper uses the lens of Charles Chesnutt’s short story collection, Conjure woman (1899 Chesnutt, C.W. 1899. The conjure woman, Boston, MA: Houghton Mifflin.  [Google Scholar]) and other tales of his in the same genre, to focus some of the theoretical problems and ontological struggles existing at the nexus of African‐American labour and leisure in the late nineteenth‐century US. Specifically, it illuminates an African‐American counterculture of incorporation. While the national incorporation of political, economic and cultural interests required the disavowal of black citizenship, African‐Americans defended their claims to national inclusion and attempted to repair the ravages of slavery and segregation on black bodies and black memory.

法经济学研究的几个热点问题述评

法经济学作为一门独立的学科地位已经确立,但是法经济学要进一步发展,首先,需要对效率与公平进行价值整合,定量分析方面则需要进一步改进;其次,法经济学的发展应该立足于实务应用研究与本土化研究,而不能满足于一般的文献介绍;最后,要重视对法经济学的学科整合研究,否则从经济学的进路研究法经济学在本质上是制度经济学或者是单一的成本收益的工具分析,从法学的角度来说,如果没有溶入经济学理论,则完全陷入法哲学的分析进路。     

设置西部军地产学研技术创新指标体系的构想

在市场经济条件下,技术创新已成为提高国家核心竞争力、企业市场竞争能力和抗风险能力的重要因素。西部地区的军工企业相对集中,需要不断提高技术进步水平和技术创新能力,发展国防科技工业。本文提出了设置西部军地产学研技术创新指标体系的构想,并从指标体系设置的意义、原则、内容、评价步骤和方法及指标体系的设计说明等五个方面加以论述。

Information theoretic multivariate graduation

Abstract

This paper presents a new multivariate graduation method based upon a constrained information theoretic methodology. The statistical formulation of the graduation problem is shown to result in a convex mathematical programming problem thus allowing the actuary to include constraints such as monotonicity along the rows, monotonicity down the column, monotonicity along the upward diagonal, as well as convexity, and any of a variety of other relationships desired for the graduated series. An illustrative application is made to the graduation of select and ultimate mortality tables.
