财产权与人的解放——财产权的人学价值及其局限

财产权对于人的全面解放的意义具有两面性。第一,在启蒙运动和资产阶级革命时期,财产权从封建专制权力的桎梏下解放出来,首次实现了绝对的财产权利和财产权与权力的分离。财产权是其它各种权利的基础,堪称对抗封建专制权力、保障人权的坚实堡垒,是人的解放的起点,在反封建的斗争中,启蒙的、资产阶级的财产权利理论和观念无疑具有进步意义。第二,绝对的财产权利具有与生俱来的弱点,它无法保障实质平等和实质正义,因而只有超越财产权利的绝对性,才能进一步实现人的解放。在共产主义社会里,自由不再是自我与他人的分界线,而会成为个人与他人联系在一起的积极力量;平等不再是与私人个体作抽象对比,而是在强大的社会里倾情参与;所有权不再是排他性权利,而是社会公共的财产权。只有超越资本主义制度、超越启蒙时期的财产权利观念,才能实现人的全面解放。

Property Rights and the Freedom of Humanity——About the Value of Humanity in Property Rights and Its Limitation

Property right had two sides of meaning for complete liberation of human being:First,during the enlightenment and the bourgeois revolution period,it helped people to keep freedom from tyranny,property right is the foundation of all the other rights. Second,the absolute property right has the inherent weakness,it cannot guarantee equality and nature of the essence of justice,and thus people cannot further realize the liberation of the people only when we no longer treat property rights as absolute.In communist society, freedom will no longer be the boundary between ourselves and others,and will be the positive energy to associate people together. Ownership is no longer the exclusive rights,but social public property rights.Only beyond the capitalist system of the enlightenment, beyond the property rights of idea,can achieve complete liberation.
