| 摘 要： | 对集体林权制度主体改革与配套改革进行全面的法律解析。认为,集体林权制度主体改革的法律意义在于落实集体林成员总有和林地承包经营用益物权的法律属性,集体林权制度配套改革是通过制度变革与创新落实林地承包经营用益物权,建立低交易成本的林权流转制度。提出,在集体林业发展过程中,良好的法律制度是有效降低社会交易成本、提高森林资源配置效率的制度路径。
