| 摘 要： | 新保险法在1995年保险法的基础上作了全面修改,其中第12条保险利益条款的修改较大。通过对新旧保险法第12条的比较和理论分析发现,新保险法第12条对保险利益的主体、生效时间均区分人身保险和财产保险作了不同的规定。从立法论视角看,对保险利益条款的这一修改使保险利益条款立法有了重大进步,反映了近年来保险法理论和实务的最新研究成果。

| Abstract: | The new Insurance law is the comprehensively amended edition of the Insurance Law made in 1995,among which Clause 12 Benefit of Insurance is greatly revised.Based on comparison and theoretical analysis of Clause 12 in the new and the old editions,this paper finds that Clause 12 of new Insurance Law lays down different stipulations regarding subject of insurance benefit,differentiated time for personal insurance and property insurance to come into effect.From the legislative perspective,the amendment reflects the latest research achievements in the insurance theory and practice over the past few years,showing that great progress has been made in insurance benefit clause legislation. |
