浅谈人才流动中的竞业禁止制度

在市场经济条件下,商业秘密是参与市场竞争的秘密武器,也是战胜同行业对手的一大法宝。市场竞争本身就是一个矛盾体,正当与不正当竞争始终并存。为了防止商业秘密的泄露,捍卫企业正当的权利不受非法侵害,各国都采取了适当的措施,建立了有效的机制。其中,推行竞业禁止制度就是一项行之有效的防止在人才流动过程中商业秘密被泄露的方法,这也是加大商业秘密保护力度的需要。本文对人才流动中的竞业禁止进行了分析、界定,以期达到对商业秘密的最大限度的保护。

A Discussion of the Non-Competition System in the Flow of Talents

Under the market economy,trade secret is the secret weapon to participate in market competition and a magic weapon to defeat the rivals.Market competition itself is a paradox.Fair and unfair competition are co-existed.To provent trade secret from leak and defend the lawful rights of enterprises from being infringed on unlawfully,all the countries should adopt appropriate measures and establish effective system.Among them,to promote the non-competition system is an effective way to prevent the leak of trade secret in the flow of talents.It is a demand for strengthening the protective level of trade secret.In this paper,the author analyzes and defines the non-competition system in the flow of talents in the expectation to protect trade secret to the maximum.
