| 摘 要： | 夫妻共同遗嘱在本质上属于共同法律行为。立法应有条件地承认共同遗嘱的效力,从法律上确认夫妻共同遗嘱的法律地位,并明确规定共同遗嘱的适用范围、适用主体、遗产范围、生效和失效、法律效力、变更与撤销以及执行等,从主体和内容两方面对夫妻共同遗嘱的适用和操作进行必要的规范。

| Abstract: | Joint and mutual will in nature is a legal action jointly proceeded by the couple.Its legal effect should be conditionally admitted in legislation to verify the legal status of joint and mutual will through clear and necessary regulation from the respects of applicable subjects and contents in applicable scale,subjects,inheritance scale,valid date and expire time,legal effect,alteration,discharge and operation,etc. |
