产业集群品牌知识产权的商标保护模式探讨——以“浏阳花炮”为例

摘    要:产业集群发展到成熟阶段所形成的集群品牌,是知识产权领域中一种新型标识性知识产权。集群品牌的俱乐部产品、共有产权等特殊经济属性,决定了政府组织、行业协会组织等公共经济主体是集群品牌知识保护的真实主体。将集群品牌注册为地理标志集体商标,证明商标是从法律上保护集群品牌知识产权的有效模式。

Abstract:The industrial cluster brand is a new form of distinctive intellectual property, which mostly occurs at the mature stage of clusters. Its specific economic attributes, such as "club goods" and communal property rights, determine the real subjects of the brand protection, who should be government organizations and industry associations. Therefore, it is a valid mode, registering the cluster brand as the collective trademark or the certification trademark of the geographical indication, to protect the intellectual property of brand.
