| 摘 要： | 精确性堪称立法语言的灵魂与生命,但在实践中,立法语言却呈现大量的模糊现象.这主要是因为立法语言作为自然语言的一种,逃脱不了自然语言模糊性的藩篱;而作为法律语言,法律本身的专业特点又使其必然呈现模糊性.然而,立法模糊语言有时会发挥其积极的语用功能,增强立法的精确性以及扩大立法的适用性,以此来克服法律本身的一些局限.

| Abstract: | Exactness is known as the soul of legislative language, however in practice there are many fuzzy expressions in legislative language. The main reason is that fuzziness is inevitable in legislative language as one of natural languages on one hand and one of legal languages on the other hand. While legislative fuzzy language has strong pragmatic functions which strengthen the exactness and flexibility in legislature. Therefore it is helpful to overcome some limits of laws themselves. |
