论网络虚拟财产的保护

随着网络游戏的出现和发展,由于网络虚拟财产引起的纠纷不断增多,但是我国目前的法律对于什么是网络虚拟财产以及网络虚拟财产的法律属性应如何界定并没有作出明确的规定,这就导致玩家的权益被损害时,无法找到相应的法律依据。鉴于我国网络游戏市场的庞大规模和巨大的发展潜力以及网络经济正迅速成为我国市场经济的重要组成部分,我们不仅要从立法上对网络虚拟财产的法律性质进行明确界定,还应努力探索各种有效的保护网络虚拟财产的方法。

With the emerging and development of network games,the dissensions caused by network suppositional possessions are gradually rising.But up till now,we do not get the clear provisions as what are network suppositional possessions and how to define the attributives of network suppositional possessions in the law of China,which leads to the following results:when the player's rights and interests are hurt,we do not get the corresponding lawful provisions.Because of the large scale and the great potential of the network game market in our country and furthermore,network economy is becoming one of the most important parts in our market economy,we should not only define the attributives of network suppositional possessions clearly in the light of law,but we should also try to find the effective methods on how to protect network suppositional possessions.
