旅游合同立法的几个基础性问题

只有明确了旅游合同的立法体例、立法目的和制度设计框架等方面的问题,才能在立法上确立旅游合同制度。现有的研究对旅游合同的概念、性质以及归责原则等方面都有了一定的积累,在上述研究基础之上,可以推导出下列结论：在不同的立法体例下,对旅游合同会有不同的概念阐释;旅行社的责任应当是立法的重点,在《合同法》严格责任的制度框架下,应当在旅游合同的归责原则方面作出过错责任的制度设计。
