论《侵权责任法》背景下的医疗损害鉴定制度

在我国卫生事业管理体制和具体实践中,存在着鉴定制度"二元化"的现象,《医疗事故处理条例》和司法鉴定制度并存,使鉴定产生缺乏公平性等问题。随着《侵权责任法》的实施,有学者认为司法鉴定将在医疗损害鉴定中起着越来越重要的作用。基于医疗的专业性、复杂性和技术性,医疗损害鉴定不是一般法医能胜任的鉴定工作,医疗事故技术鉴定制度仍是一项可利用的制度资源。文章运用文献检索法,获取近期权威的研究资料和有关鉴定制度的法律法规,采用对比研究方法进行理论分析。通过论述我国现行医疗损害鉴定法律制度存在的缺陷,在对我国国情、现行法律体系的分析考量基础上,为我国现行医疗损害鉴定法律制度的进一步完善提出相应的建议和构想。
