| 摘 要： | 空间地上权是指在他人土地之空中或地下一定空间范围内以有建筑物或其他工作物为目的而使用他人空间的权利.空间地上权由于在立法上没有定义性的规定,所以对其内涵的界定不统一.对其进行界定时必须在其概念中包含区别于普通地上权的特定属性.由于这一权利客体的特殊性决定了我们必须正确分析其物权法属性.同时我国将空间地上权规定在建设用地使用权一章中的立法体例是存在缺陷的,为此我们应采取采取基本法与单行法并列的双重立法模式.

| Abstract: | Superficies of space refers to the others in the land of aerial or buried within certain space in a building or other work for the purpose of using other people space right.Superficies of space because the legislation is not defined rules,so The definition is not uniform,the definition of the concept should include the difference from the general superficies specific properties. Because of this the rights object particularity decided we must correct analysis of the property law attribute.At the same time,our country will superficies of space requirements in the construction land use rights chapter legislation system is flawed,so we should take basic and special law of dual legislation pattern. |
