| 摘 要： | 对CEPA中关于服务提供者准入条件进行分析,指出其对原有GATs框架下关于服务提供者准入资格规定的继承发展及发挥的积极作用,同时强调其在我国现有的法律体制下并不能及时有效地对服务市场开放后产生的“溢出效应”作出反应,应当进一步在程序上把关,确保CEPA真正对香港与内地企业产生积极作用。

| Abstract: | The paper discusses the market-admittance criteria for the service suppliers in CEPA. It points out that CEPA is regarded as the inheritance to advancement of the GATs in regulating the admittance of the suppliers. However, the current legal system fails to react duly and efficiently to the "spillage effect", in which the preferential arrangement in CEPA would be abused by the third party after the opening of the service market. The paper argues that in order to insure the promotion of the enterprises both in Hong Kong and the mainland through CEPA, more institutional arrangements in the procedure should be taken into account. |
