| 摘 要： | 发展基金业的关键是基金业立法，而基金立法要解决的问题不是一部简单的所谓的“基金法”。本文通过对德国基金业立法的核心法——《投资公司法》的全面剖析，概括了其立法的市场基础和逻辑关系，并结合我国已在进行的基金立法工作，从而得出了几点有益的启示或结论。

| Abstract: | The key to developing the fund sector lies in legislation. Problems concerning the legislation in the fund sector cannot be solved simply by one so-called Fund Law. By fully analyzing the Investment Company Law, the core law in Germany's legislation in the fund sector, this article summarizes the market foundation and logic for the legislation. In combining these with China's ongoing effort towards legislation in the fund sector, the article provides enlightenments or draws some useful conclusions. |
