| 摘 要： | 近几年,由于市场竞争日益激烈,一些不良的经营者为了谋取商业利益,采取贿赂手段拉拢受贿人,致使商业贿赂现象愈演愈烈。商业贿赂犯罪呈逐渐上升趋势,严重破坏了原本良好有序的市场经济秩序,剥夺了其他同行业经营者的公平交易机会。本文从商业贿赂犯罪的形成原因入手,探讨我国刑事立法之不足,提出了完善我国商业贿赂犯罪的刑事立法防控建议。

| Abstract: | In recent years,with increasing competition,some unscrupulous operators in order to obtain the commercial gains,give bribes to win over cases,which causes intensified commercial bribery.Commercial bribery gradually increases.Then it seriously undermines the original sound and orderly market economic order,deprives other industry operators with fair trade.This paper intends to analyse the causes of commercial bribery crime and the insufficiency of our criminal legislation,and give some suggestions about a complete set of commercial bribery prevention and control of criminal legislation. |
