| 摘 要： | 商业秘密权与商业秘密是权利与权利客体的关系,它与以专利为代表的传统知识产权相比较,在权利主体、客体、权利内容、保护期限方面等方面都有较大的差异。对商业秘密权的法律保护,应秉承维护商业道德、促进技术进步的宗旨,构建起一个"投入——回报——激励"的体系。 |

| Abstract: | The right of protecting business confidentialities reflect the relationship between right and its object.In relevance to the traditional intellectual property rights,the former right has its own characteristics,such as its subject,object and connotation,etc.In order to protect this right,it is necessary to stick to protecting trade moral and promoting the technical development while constructing a input-output-incentive system. |
