对农地转租中低地租现象的一种解释

研究目的：研究农地转租过程低地租现象存在的原因,促进农地租赁市场良性发展。研究方法：文献资料法和因果分析法。研究结果：农地出租人对承租人事后机会主义行为的预期导致了农地转租行为很大程度上依赖于“亲戚社会”内部成员的隐性承诺,这种带有专有性特征的隐性承诺赋予农地承租人较强的缔约谈判力。为了避免农业专用投资受到出租人事后机会主义行为的威胁,承租人势必将谈判地位优势转化为对租赁剩余收益的控制,并最终形成了低地租现状。研究结论：取消户籍制度、健全农地市场的交易服务中介可以消除农地转租的外部约束条件,培育农户的市场意识,增强农地供给方的转租意愿。

An Explanation on Low Land Tax in Farmland Tenancy

The purpose of this study is to analyze the reason of low land tax in farmland tenancy and boost the sound development of farmland tenancy market. Methods of documentation and causality were employed. The results indicate that, due to farmland lessor's anticipation about opportunism of land lessee, the behavior of farmland tenancy relies on implied promise of "acquaintance society" to a large extent. This implied promise has exclusive characteristic, which endows land lessee with strong negotiation ability. In order to make agricultural specific investment free of threat of farmland lessor's opportunism, farmland lessee will convert strong negotiation ability into control for residual income from the tenancy. Ultimately, low land tax come into being. It is concluded that abolishing the household registration and setting up the deal agency can eliminate outer restriction condition of farmland tenancy, cultivate the market consciousness of the farmer and boost up the tenancy will of farmland's supply.
