论我国政府环境信息公开制度

政府环境信息公开是民众环境知情权得以实现的重要保障。我国于2008年5月开始施行的《环境信息公开办法（试行）》，为政府环境信息公开制度提供了重要的法律支撑。但是，该法施行数年来，也暴露出了诸多亟待解决的问题，如立法层级较低、环境信息公开内容与范围界限不够明确、救济缺乏可行性等。应当尽快确立环境知情权的基本权利地位，提升环境信息公开制度相关立法的层级；明确环境信息公开内容范围，细化信息安全界限；拓宽环境信息公布方式；优化环境信息公开的救济程序；完善整体配套制度等。

Discussion On Environmental Information Disclosure System

The disclosure of government environmental information public is a very important guarantee to realize people＇ s right of knowing the environment. China start the implementation of the ＂measures for the disclosure of environmental informa- tion （for Trial Implementation ） ＂ in 2008 May, and the disclosure of government environmental information system provides important legal support. However, the law exposed many problems when implemented for several years, such as lower legislative level, environmental information disclosure content and limits are not clear enough, lack of remedy feasibility. In view of these problems, we should establish the environmental fight to know basic fights as soon as possi- ble, enhance the environmental information disclosure system in legislation hierarchy; clear disclosure of environmental information content, detailed information security boundaries; widen the environment information; optimizate environ- mental information disclosure relief procedure and improve the overall supporting system.
