“日落复审”条款在一些国家的反倾销、反补贴立法中还是比较新的内容,各个国家的具体规定也不尽相同。随着经济全球化的深入发展,国家间的竞争日趋激烈,中国需要采取更有效的措施来应对国外不公平竞争的冲击,而重视和利用“日落复审”则是我们要坚持的一项重要原则。因此,我们一方面要对各国的“日落复审”条款进行仔细的研究,另二方面要结合中国的实际情况找出应对策略,以此指导中国的反倾销实践。

Comparative Analysis of the Internationally Practiced "Sunset Clause"

The "Sunset Clause" is a new measure in some countries'legislation for anti-dumping and anti-subsidy and its content is somewhat different in different countries. The paper states that the more effective measure for China to take against the unfair assault from abroad is the utilization of "Sunset Clause". Therefore, researches and careful examination of the "Sunset Clause" adopted by different countries should be carried out, together with the efforts to work out countermeasures, so as to guide the Chinese enterprises against anti-dumping.
