论公民的基本旅游权利及其法律依据

公民的基本旅游权利是宪法赋予公民的政治、经济、社会、文化权利在旅游领域的具体体现。长期以来,由于对这一权利认识上的模糊,使得旅游界和广大公众难以有效地行使这一权利,旅游领域的许多问题与此密切相关。对＂公民基本旅游权利＂的概念给以初步的揭示和解读,根据中国宪法公民权的相关规定,从＂宪法公民权利＂中分离出＂公民旅游权＂,分析了这一基本权利的法律地位和性质,为公众更好地行使这一权利,提供相应的法律依据,为旅游业的改革创新提供一定的理论思考。

On the Basic Tourism Rights of Citizens and its Legal Basis

The basic tourism right of citizens is a specific tourism performance on the political, economic, social and cultural rights. For a long time, this right can not exercised effectively because of the fuzzy understanding about it. Many tourism problems are closely linked with it. The paper puts forward a concept of ＂the basic tourism rights of citizens and gives it a preliminary explanation. The paper also isolates ＂the civil tourism right＂ ＂from the civil constitutional rights＇,analyzes its legal status and nature,and provides the legal basis as well as the necessary reference for the purpose of a better exercise,innovation and de- velopment of the tourism industry.
