林地与耕地矛盾初探

人口的快速增长,对林地和耕地产生了巨大的压力,特别是在我国的南方林区,普遍存在着林业和农业分散经营的现象,因此便产生了林地与耕地之间的矛盾。文章着重从法律实践角度分析了林地、耕地相邻权问题,并对退耕还林中因林地与耕地矛盾产生的问题及其解决方法进行了初步探讨。

Preliminarily probing into the contradiction of forest land and cultivated land

The forest land and the cultivated land are under huge pressure with the rapid increase of population, especially in the southern forest region of our country, where there is an universal phonomomen that the forestry and agriculture are managed separately at the same time in the same area, therefore it leads to the contradiction of forest land and cultivated land. The analysis of the problems with the adjacent rights of forest land and cultivated land are made emphatically in terms of legal pactice. Besides, the problems and the solutions caused by the contradiction of forest land and cultivated land due to returning land for farming to forestry are probed and studied preliminarily.
