召回制度中缺陷产品认定标准之探究

我国现行立法对缺陷产品的规定并不一致,容易造成法律适用上的问题。召回制度中缺陷产品的认定应实行单一的不合理危险标准。在采用该标准进行判断时,应当以使用者对产品合理的安全期待来衡量。为完善召回制度中缺陷产品的认定标准,应制定统一的缺陷产品召回法,作为召回基本法;关于缺陷产品含义的界定应明确其具有不合理危险的唯一属性;对产品法定标准的制定和修改要设定相应的义务和责任,以建立健全对法定标准的有效监管。

On Testing Standards for Defective Product in Recalling System

The legal rules for defective product are different in China,which is apt to cause problems to applicable law.The testing of defective product in recalling system should apply the only standards of unreasonable danger.When judging according to the standards,it＇s necessary to take product users＇ reasonable safety expectation into consideration.It＇s necessary to draw up a unified recalling law,which is regarded as a basic recalling law,to perfect the testing standards for defective product in recalling system.As for the definition of defective product,it＇s important to clarify the single attribute of unreasonable danger.It＇s essential to set appropriate duty and obligation for the formulation and amendment of legal product standards to exercise and improve supervision of legal standards.
