论农村失独家庭的再生育权

农村失独家庭是不容忽视的庞大群体,再生育问题对和谐家庭、和谐农村以及和谐社会的构建意义重大。农村失独家庭的再生育权应包括再生育自由权、再生育方式选择权、再生育受助权等内容。针对农村失独家庭再生育存在的问题,应由国务院依据《中华人民共和国人口与计划生育法》等相关上位法制定专门的单行条例,并应将再生育自由权保障机制、再生育方式选择权保障机制、再生育受助权保障机制的构建作为条例的重要内容。

On Rural Loss-of-only-child Families' Reproductive Rights

The rural loss-of-only-child families are a large group that should not be ignored, whose reproductive problem has great significance on the construction of harmonious families, villages and society. Their reproductive rights should include the right to choose whether to bear new baby, how to bear new baby, accept help in reproduction and so on. In light of the problems in the rural loss-of-only-child families＇ reproduction, the authors thinks that the State Council should formulate special decrees according to relevant higher-level laws such as ＂Population and Family Planning Law of the People＇s Republic of China＂ and in the decrees the construction of the guarantee mechanisms for these families＇ right to choose whether to bear new baby, how to bear new baby as well as accept help in reproduction should be included as an important content.
