| 摘 要： | 金融刑法体系在金融体制改革中得以建立,但立法前瞻性不足、与其他金融法规不协调等问题有待进一步完善。金融法律应具体规定金融犯罪的罪状,不具体规定其法定刑或通过空白法定刑方式规定如何追究其刑事责任;刑法典通过空白罪状的方式规定金融犯罪的罪状,并具体规定其刑事责任的承担方式。

| Abstract: | Financial legislation system has established in financial system revolution.However,issues such as lacking of perspective and short of coordination with other financial laws should be improved.Financial legislation should stipulate the facts of different financial crime.And it should not set out the sentence method;and stipulate the responsibility of different crimes. |
