| 摘 要： | 笔者曾于2001年底至2002年初作为原告A船厂的诉讼代理人参与了一件非常有意思的、关于仲裁条款有效与否的船舶买卖合同纠纷案件。该案尽管以管辖法院支持原告A船厂的不存在合同关系和仲裁协议诉讼请求而告终，但该案仍遗留了一些值得思考的法律问题：如，如何正确理解仲裁协议独立性和仲裁庭管辖权问题？如果原告A不是选择在中国进行确认之诉讼而是在英国法庭申请中止仲裁程序并提起仲裁条款无效的诉讼，

Reflection over the Dispute of a Ship Trading Contract |

| Abstract: | The writer, as the next friend of the accuser - A shipyard, attended an interesting case about the dispute over a ship ＂trading contract, which related to the validity of the arbitral clauses. Though the case ended as the jurisdictional court supported A shipyard in having no contract relationship, there still remain a few legal issues worth further consideration. |
