摘    要:产权市场为国有资产存量提供了进退通道,有利于国有资产存量的结构优化,防止国有资产流失,也为民营资本和外资参与国有资产重组架起了桥梁。加强产权市场管理,需要制定中国产权市场的发展规划,改进对产权交易中介机构的监管,科学确定产权交易价格,规范企业产权出让收入的处置工作,完善产权交易的社会保障体系。加速产权市场的法制化建设,必须明晰企业产权界定,规范产权交易经纪主体及其法律关系,依法规范资产评估程序,加强对产权交易的法律监督,构造完整的企业产权交易法律体系。

Abstract:Property rights markets (PRM) provide tools for the stated-owned stock assets' entry and exit,and benefit the optimization of assets structure. In fact, PRM act as a bridge for the private and foreign capital to participate in the restructuring of state-owned assets, and can effectively stop the loss of state-owned assets as well. In order to reinforce the management of PRM, we have to make a long-run planning for its development, improve the supervision upon the intermediaries for property rights exchanges, scientifically price the exchanging property, regulate the income from enterprise assets selling, and strengthen the social security system related to the property rights exchanging. To speed up the legal construction of PRM, we must define the enterprise property rights clearly, and standardize the broking subject and the legal relations in property exchanges. In addition, we have to normalize the asset evaluation process according to the laws, strengthen the legal supervision on the property rights exchanges, and establish an integrated legal system for PRM.
