企业改制中“买断工龄”的若干问题探讨

摘    要:“买断工龄”是与企业改制相伴随的经济行为,但其合法性是受到质疑的,且有明显的违约倾向。无论从程序上还是实体上,“买断工龄”都存在明显的不公平。在我国社会改革的大环境下,在程序上应当使“买断工龄”公平、公开、公正,具有合法性,实体上应当足额补偿职工,同时,应当加强政府在企业改制中对劳动权保障的责任。

Abstract:"Buying out the length of services" is economical actions which go along with strypped-down of enterprise.But its validity has been oppugned.It breached of faith yet."Buying out the length of services" is unfair not only in procedure but also in substantiality.In the surroundings of reformatory of our society,we should make it validity,justice,open and equity in procedure.And the employees must be sufficient redeemed.Contemporary,the government should strengthen the liability of guarantee of labor rights.
