论现代国际私法实质正义价值取向

与＂法则区别说＂时代的国际私法比较,现代国际私法更注重对实质正义的追求和实现。针对这一现象,在考察前现代国际私法的基本价值追求和表现形态的基础上,分析现代国际私法以追求实质正义为精神内核,由此呈现出现代国际私法对实质正义的追求发展是人类对整个法律价值追求演进的一部分,简明提出实现现代国际私法实质正义的途径与方式。

Analysis on Modern Private International Law Essence Just Value Orientation

Comparing with private international law of ″the principle different theory″ times, the modern private international law pays great attention to the pursuit and realization of substantive justice. In response to this phenomenon, based on the study of basic values pursuit and manifestations of the pre-modern private international law, this paper analyzes that modern private international law made the pursuit of substantive justice as the core, thus showing that the substantive justice pursuit of modern private international law is the part of the pursuit that human pursued the legal value. Finally, this paper briefly proposes the ways and means to achieve the substantive justice of modern private international law.
