| 摘 要： | 当下经济生活中普遍存在的房屋典当，虽然被《典当管理办法》规定为典当，但其与传统民法中的典当有所差别。同时，房屋典当与用益物权和传统民法中的典权不也相同。从本质属性上看，其应属于担保物权。当前形势下，房屋典当的这一性质应当在司法实务中灵活处理并尽早通过立法予以确定。

| Abstract: | The housing pawn exists in the current business life. Pawn Management Methods is prescribed as a kind of pawn, but it has big differences with the pawn in the traditional civil law. Meanwhile, housing pawn differs from the mortgage right in the traditional civil law as well as usufruct right. As a matter of fact, housing pawn belongs to security interests. Nowadays, this characteristic of housing pawn should be treated flexibly and be prescribed definitely by means of legislation. |
