土地督察制度理论研究与实证分析——基于国家土地督察数据的分析

社会经济发展和政治体制变革是土地督察制度建立的重要诱因，行政监督理论是土地督察制度运行的理论支撑，土地督察制度是建立在现实和理论可行性基础之上的。分析2008—201o@-土地督察数据，土地督察制度的实施在一定程度上限制了地方土地行政权力的扩张，遏制了土地违法行为，规范了用地审批行为；保障了土地资源公共利益的实现，促进了耕地资源保护、中央土地政策落实、土地行政管理体制的完善。土地督察制度同时也存在进一步改进和发展的空M，从土地督察实践上看，近期可以进行一定调整，进一步明确督察机构法定职责和工作目标；从土地督察理论上看，远期还可探索土地督察机构地位独立问题。

The Research on the Theory of a System for Supervising Land Use and Administrative Empirical Analysis --Based on the Analysis of State Land Supervision Data

With social and economic development, as well political system changes, a system for supervising land use has been built; and the theory of administrative supervision is the theoretical supports for the land supervision system operation. Therefore, the system for supervising land use is built on the basis of the realistic and theoretical feasibility. Analysis of land supervision data from 2008 to 2010, it shows that the implementation of the land supervision system, to some extent, limits the expansion of local executive power in the land, restrains illegal acts against civil laws related to the land, and regulates the behavior of the land examination and approval. Meanwhile, the realization of land resources in the public interest has been guaranteed. The protection of cultivated land, the implementation of the central land policy, and the improvement of land administration system has been promoted. Finally, this paper points out that from the practice, statutory duties and work goals of supervision institution should be further defined; and from the theory, the issue concerning independent status of land supervision institutions can be explored at a specified future date.
