| 摘 要： | 根据我国现阶段未成年人犯罪的具体情况,并参考国外的相关立法经验,认为我国《刑法》等法律中对于未成年人相对负刑事责任年龄的规定应予以修改,即降低未成年人的相对刑事责任年龄标准,将刑事最低责任年龄降低至12周岁,将行政法规当中有关未成年人的适用年龄与《刑法》中未成年人刑事责任年龄的规定挂钩。

| Abstract: | According to our country's present situation of juvenile crime and the relevant foreign legislative experience,the author holds that the rules about the under-age line of the responsibility for a crime in The Criminal Law should be revised.The age standard for it should be lowered to 12 years old and the applicable under-age line in administrative rules should be conformed to the under-age line in The Criminal Law. |
