中国农民土地权益保护路径分析

研究目的：寻找并确定有效保护、实现农民土地权益的制度路径。研究方法：实证法，比较法，规范分析法。研究结果：只有完善的宪法制度才能防范立法和行政权对农民土地权益的侵害。农民行使土地权益的配套制度建设需要宪法的支持。消除宪法和相关法律对集体土地与国有土地的不平等待遇，才能真正维护农民应有的土地权益。研究结论：保障财产权应是宪法的基本内容，中国宪法应在基本权利与序言中明确保护农民土地权益。

Analysis on Approach to Protect Farmers&rsquo|Rights and Interests Related to Land in China

The purpose of this paper is to find and identify the systematic solution for effective protection and realization of the farmers’ rights and interests related to land. Methods of empirical, comparative and normative analysis were employed. The results indicate that only a perfected constitution can prevent the rights and interests of  farmers related to land from violation from the legislative and administrative authorities. The supplementary institutions for farmers’ land use rights and interests require constitutional support. Only elimination of the unequal treatment in collective-owned and state-owned land at constitutional and administrative law levels can truly ensure the land rights of farmers that deserved. It is concluded that protection of property should be a basic content in constitution. China’s constitution should protect farmers’ rights and interests related to land clearly by stating it in the fundamental right part and in the preface.
