试论依法执政的宪政基础

依法执政是法治国家对政党的基本宪政要求。现代宪政所包含的民主、法治和人权基本价值原则和理念，体现于依法执政的各个领域。民主作为依法执政的制度前提，要求依法执政必须是民主执政；法治作为依法执政的机制保障，要求执政党的一切活动不偏离法治轨道；人权作为依法执政的价值追求，则要求执政党切实做到执政为民，真心诚意为人民谋利益。
