| 摘 要： | 《刑法修正案（八）》是我国社区矫正立法化进程中的里程碑,我们应该顺势而为,从以下方面继续推进我国社区矫正立法化：第一,明确认定社区矫正行刑性和社会性双重法律属性;第二,适时制定《社区矫正法》;第三,明确司法行政部门是我国社区矫正的执行机构;第四,规定社区矫正官为我国社区矫正的执法人员;第五,加强自治型社区建设,推进社区建设和社区矫正良性互动发展。

| Abstract: | ＂Criminal Law Amendment（eight）＂ is the milepost in the process of China＇s community correction legislation,we should go for,from the following aspects to promote China ＇s community correction legislation： first,clearly identified the community＇s correction and social dual attribute of law;second,timely make ＂community correction law＂;third,judicial administration is enforcing community corrections in China institutions;fourth,provisions of community correction officer for our community correction of the law enforcement personnel;fifth,to strengthen the autonomy of community building,promoting community construction and community correction,benign and interactive development. |
