谈跨行政区域水污染纠纷处理

随着工业化、城市化步履的不断加快,水污染问题日益严重,水资源开始出现紧缺,因水污染造成的纠纷,尤其是跨行政区域的水污染纠纷的矛盾表现更为尖锐.针对我国目前在处理跨行政区域水污染纠纷中存在着法律规定的缺陷,行政部门相互协调不足及注重实体法,轻视程序法等方面的问题,提出完善流域管理体制,健全有关跨行政区域水污染纠纷处理的法律法规,建立相关制度,进一步完善跨行政区域水污染纠纷处理方法,使非诉讼方法和诉讼方法并重,以促进跨行政区域水污染纠纷的解决.

On Settlement of Cross-Administration Region Water Pollution Dissensions

With the rapid development of industrialization and urbanization, the issue of water pollution has become increasingly serious. Scarcity of water resources has started to appear, and dissensions caused by water pollution, especially cross-administration region water pollution dissensions, have become more incisive. This paper points out such problems as deficiency in legal provision of this country, lack of cooperation in administrative departments, emphasis on substantive law and contempt of procedural law in settling cross-administration region water pollution dissensions, puts forward some suggestions to improve drainage basin managerial system, perfect laws and regulations related to settling cross-administration region water pollution dissensions, create some new systems and attach importance both to the non-lawsuit method and the lawsuit method to settle cross-administrative region water pollution dissensions effectively.
