工艺美术专利权的保护现状分析——以云南省为例

工艺美术作品给人们的感官提供服务,它本身的艺术特质也掺杂了作者的人格在其中,让其产生的知识产权多数成为著作权的保护客体。如今部分工艺美术类知识产权申请了专利权保护,但在对云南省工艺美术大师所发明的专利数据进行收集整理后,发现当前使用专利权保护工艺美术行业产生的知识产权具有局限性,在今后使用专利权保护工艺美术行业的知识产权时,应注意针对保护的局限性,使专利权更好的服务工艺美术行业,节省社会资源。

Analysis on the Protection of Patent Rights in Arts and Crafts——Taking Yunnan province as an example

Arts and crafts works provide services to people''s senses, and their own artistic characteristics miscellaneous the author''s personality, so that most of the intellectual property rights it produces become the object of copyright protection. Nowadays, some intellectual property rights of Arts and crafts have applied for patent protection, but after collecting and sorting out the patent data invented by the masters of Arts and crafts in Yunnan Province, it is found that the current use of patent rights to protect intellectual property rights of Arts and crafts industry has limitations, and in the future, the use of patent rights to protect the knowledge of Arts and crafts industry. In property rights, we should pay attention to the limitations of protection, so that patent rights can better serve the arts and crafts industry and save social resources.
